IBA'S AFFIDAVIT (Notarized in the Regiser vide ref.#226/530) IN SLP(C) NO. 5561/2016 OF LATE COM.MC SINGLA & Ors. WAS FILED IN THE SUPREME COURT  ONLY ON 24 th. AUGUST 2022.

THE SAID AFFIDAVIT WAS FILED JUST  IN THE PREVIOUS (AUGUST) MONTH ONLY... Ie. LONG AFTER THE TRIPARTITE CONCILIATION PROCEEDINGS BETWEEN IBA UFBU & CLC ON 01 07 2022  WHERE UFBU CALLED OF THE STRIKE ON PENSION REVISION & OTHER RESIDUAL ISSUES WITHOUT ANY EXPLICIT ASSURANCE FROM THE IBA

IN THIS BACK DROP, THE AVERMENTS MADE IN THE ABOVE AFFIDAVIT ARE FAR FROM TRUTH BESIDES EXHIBITING  ARROGANCE & UTTER DISREGARD TO THE STATUTORY PROVISIONS OF THE PENSION REGULATIONS BY THE  IBA-UFBU NEXUS.

I QUOTE HERE THE INSTANCE WHERE THE SANCTITY OF SUCH AFFIDAVITS OF "LIES" WERE UNDONE SUBSEQUENTLY AND MADE REDUNDENT WITH ALL THE CONTEMPT THEY DESERVE.

HISTORY VOUCH SAFE THIS FACT.

RBI RETIREES FILED A CASE FOR THE RESTORATION PENSION UPDATION WHICH WAS REMOVED
AT THE SPECIFIC DIRECTION FORM THE DFS/MOF.  IN SUPPORT OF THE ILL-CONCEIVED STANCE, THE  RESPONDENTS FILED A WRITTEN STATEMENT BEFORE THE COURT AS AFFIRMED IN  THE OFFICE NOTE RECORDED BY DFS/MOF
SUBSTANTIATING " THE CONTAGIAN EFFECT ON THE PUBLIC SECTOR BANKS " AS AN "ELIBI" FOR THE REMOVAL OF THE EXISTING PENSION UPDATION FOR RBI PENSIONERS. 
THE  MUMBAI HIGH COURT, WHILE REPRIMANDING THE GOVERNMENT, DISPOSED  THE CASE IN FAVOUR OF THE RBI RETIREES.

THAT'S HOW, DESPITE THEIR INITIAL DENIAL ON 26 02 2018 ON A FRIVOLOUS GROUND OF CONTAGIAN EFFECT ON PSBs, THE SAME DFS/MOF  THEMSELVES  HAD TO REVERSE THEIR OWN EARLIER STAND AND RESTORED PENSION UPDATION FOR RBI RETIREES  EFFECTIVE FORM 01 03 2019.

WHEN THAT IS  THE SCANT  RESPECT FOR THE SANCTITY OF THE AFFIDAVIT FILED BEFORE THE COURT BY NONE LESS THAN THE DFS/MOF ITSELF,  WHARE IS THE SANCTITY FOR  THE SO CALLED  AFFIDAVIT NOW FILED BY IBA WHO DOES NOT HAVE ANY LEGAL STATUS. (Click the following audio link for more details)

 Point No.(iv) of paragraph 5.  on the subject " Periodic updation of pension " in page No. 264 of the Office Note  dt.  Jan - Feb, 2018 of  the Department of Financial Services - (IR), Ministry of Finance clearly depicts as follows:

(iv) " Contagion effect on PSBs/FIs may have cascading effect on Banking industry as it is mentioned in Industrial level Settlement of 1993 at the time of introduction of Pension in PSBs that applicability, commutation of pension, family pension updating and other general conditions, etc. will be on the lines as in RBI . PSBs retirees have been arguing for updation of pension. Balance Sheet of RBI is integrated with Balance Sheet of GOI, as after providing for necessary expenses etc., all surplus is transferred to the Government ."

However, despite communicating it's denial on RBI's request for updation through its communication dt. 26 02 2018  also on the ground of the said contagion effect on PSBs  , the MOF had decisively sanctioned the formula for updation  of pension to RBI through its communication dt 05 03 2019 but to give  it effect prospectively from 01 03 2019.

Subsequently MOF  had accorded similar sanction of formula for updation to NABARD with prospective effect from 01 08 2020.

In view of the already denoted 'contagion effect' in its said office note , consequent sanction of similar updation as in RBI  for the  NABARD also,  it is quite but natural for the PS  Banks retirees to expect a legitimate and simultaneous  sanction of updation formula  from the GOI to PS Banks also  honouring the Constitutional guarantee provided for  in article 13  for the consistency of laws among similar  bodies of the 'State'  as defined under article 12,  guarantee for the  equality of and equal protection of the laws for Govt. employees as provided for under articles 14 & 16(1).

Hence it is imperative that the GOI is left with no reason to hear or seek guidance whatsoever  from any quarter of IBA but for upholding its own considered stand on the industrial level agreement dt. 29  10 1993   with due respect to  the provisions  under articles,12,13,14,& 16(1)  while  showing  regard to relative provisions for updation in  CCS Pension Rules 1972/1981 as could be followed by the very GOI (MOF) while according its  said sanction dt 05 03 2019 to RBI.  

Like in RBI, the Balance Sheets of PS Banks are integrated with the Balance Sheet of GOI, as after providing for necessary expenses ( as mandated in Section 10(7) of Act 5 of 1970/1980  while following due procedure laid for the purpose under   Pension  Regulation 11)etc., all surplus is being  transferred to the Government only.  

Let wisdom prevail on  the helm to get the release of dignity of the hapless bank pensioners under the undue seize of  the Executive . TAT SAT.
