My Dear Friends,
As already informed earlier , I annex here under the text of my communication under the caption " A HUMBLE PRAYER FROM A SENIOR BANK RETIREE...." addressed to His Lordship Sri Ranjan gogai, Hon'ble Chief Justice of India, and other Hon'ble Judges of the Apex Court.

I reiterate to state that this communication of mine assumes lot of importance in the wake of the committed action taken by the HIs Lordship, the Chief Justice to ensure Judicial Transparency as already enunciated by me in my earlier communication.
I also drew the attention of His Lordship to our bitter experience in our bid to seek justice for over 15 long years that ultimately COMPELLED US TO FILE A CURATIVE PETITION (C) #000243-/2019 (RIGISTERED ON 28 05 2019) in our 100% DA case ( against the Review Petition)

At the outset, Kindly accept my hearty congratulations for your lordship's concern and commitment to bring transparency in judicial functioning which has been a long awaited dream of the people at large.
This is a great solace to all of us sir ! - Much in particular to all the senior citizens who have been making their frustrating efforts relentlessly seeking justice at the fag end of their lives with one foot in the grave !
At this juncture, I make my humble submissions to Your Lordship as to the glaring injustice meted out against us in a long drawn legal battle for justice and fair play. The antecedents are as follows:
RE: EMBEZZLEMENT OF FUNDS IN THE EMPLOYEES PENSION CORPUS - THE LIFE-TIME SAVINGS OF THE BANK EMPLOYEES ARE IN DANGER - REQUEST TO ORDER FOR "CAG" AUDIT - "SOS"
I furnish here the relevant part of the following Link (Annexure : C) - ie. legal notice dated 28th. January, 2019 served on the Oriental Bank of Commerce: FOR A " BREACH OF TRUST"
QUOTE:
"........ 2. That as per RBI directives, when any loan or advance becomes NPA, certain amount of provisions are to be made out of profit of the bank. Whereas, no provision is ever made for any investment in banking sector and no loan or advance can be made from pension fund. By violating the provisions and the RBI Directives, the Oriental Bank of Commerce made investment of Rs. 20 crores in Amtech Auto Industries, which already had loan advances from various banks including Oriental Bank of Commerce. The Amtech Auto has become bankrupt and the investment of Rs. 20 crores have gone bad. The Oriental Bank has made provision of RS. 5 crores for investment of 20 crores.
There is no provision for making provisions on investments in RBI manual neither there is any provision in pension regulations to make provisions on investments. The directives of RBI are not applicable on Pension Fund Trust whereas the trustees misappropriated Rs. 5 crore from this pension fund and this act of the bank was well within your knowledge and the Board of Directors along with the other decision makers but intentionally the same was ignored and as a result of misappropriation, breach of trust took place........"
UNQUOTE:
The Irony part of it is, The above misappropriation is well within the knowledge of the Board Directors of the Bank including the Directors nominated by the RBI and Govt (Min.of Finance) who eventually head the Audit Committee constituted by of the Bank's Board of Directors. It is also well within the knowledge of the Statutory Auditors appointed by the Reserve Bank of India even.
Your Lordship , this is only a "TIP OF THE ICEBERG" and many more Skeletons may fall out from the cupboards of the other Banks too.
And, this alone is the reason behind my fervent appeal to your Lordship to CAUSE AN AUDIT BY CAG - THE ONLY CONSTITUTIONAL AUTHORITY WHO ALONE CAN DO JUSTICE TO THE JOB.
The Managements/IBA/MOF had even successfully mislead the Hon'ble Apex Court with false statements only to deny the long awaited statutory benefits to the lamenting lot of the bank retirees payable from out of their own funds which are readily available in the Pension Corpus - It's indeed An act of Sabotage !

Hon'ble Sir, If this way, the banks tend to resort to cheat their own retired employees by depriving them of even their statutory benefits (Pension Regulations) as already accorded by the Parliament, then what would be the fate of the BANKING PUBLIC IN GENERAL ? -

In this connection, I made an effort to invite the kind attention of Your Lordship to the the glaring CONTRADICTING STANCES TAKEN BY THE APEX JUDICIARY while disposing of the TWO IDENTICAL CASES related to the senior bank retirees within a very short span of just 3 months gap - ie.:
Between : 13th. FEBRUARY, 2018* AND 16Th. MAY, 2018** - JUST THREE MONTHS GAP - THAT TOO, AFTER HAVING BEEN KEPT THE JUDGMENT PENDING FOR PRONOUNCEMENT FOR OVER 10 LONG MONTHS even without considering the observations made by the Hon'ble Hight Court of Judicature; Kolkotta besides in total contradiction to the Speaking Order of the same Supreme Court dtaed 13th.Feb.2018 in CA # 5525 of 2012 . As one among over two-lakh senior-most bank retirees, many of them being octogenarians, I voluntarily make my above Humble Submissions to Your Lordship praying to:
TO CAUSE ORDER FOR "CAG" AUDIT ON "SOS" BASIS IN VIEW OF THE IMPENDING DANGER TO OUR PENSION CORPUS IN ALL THE BANKS
only to render justice to this lamenting lot of Super Senior Citizens waiting for their turn to meet their colleagues who had already attained their "Heavenly Abode".
