Pursuent to the Judgment pronounced by the Hon’ble Supreme Court dtd. 13th February, 2018 on 1616-1684 DA anomaly, some banks seem to have already commenced the process for the disbursal of the arrears. Still some banks are not yet initiated the process even.
Bank of Baroda Retired Officers Association , being one among the respondents, have directed all their eligible members to address a letter as per the draft sent by them. - To quote:
“PAYMENT OF ARREARS OF REVISION OF PENSION WITH INTEREST @ 9% - IMPLEMENTATION OF HON'BLE SUPREME COURT JUDGEMENT DATED 13-02-2018 (DA MERGER 1616/1648):
This matter has also been cleared by BCC and now Head Office shall be ON THEIR OWN arranging to calculate the arrears of eligible Retirees, which may take about 15/20 days. Then HO shall be intimating/paying the arrears to the concerned Retirees individually. The details of arrears calculated in each individual case shall also be put on Bank's Website.
The list of BOBROA's Members who retired between 01-04-1998 and 31-10-2002 WITH FIRST PENSION OPTION is attached herewith.
While Bank shall be paying the arrears ON THEIR OWN (WHETHER CLAIMED OR NOT), the concerned eligible Retiree may send the request letter AS PER FORMAT ATTACHED to the General Manager (HR Operations) by Speed Post.”

In above matter, I write to inform you as under :
1. It has been, my proud privilege to serve in our esteemed organization for about…….. years.
2. Since, I opted for pension under ……….. (Employees’) Pension Regulations, 1995 (hereinafter referred to as “Pension Regulations”) and I had been entitled to receive pension and the same under Pension Payment Order (PPO) No.__________ is being paid to me since __________.
3. That anomaly of improper reckoning of the ‘Pay’ for the pension calculation for the retirees during the period 1.4.1998 to 31.10.2002 (adverting to the Joint Note dated 14.12.1999 and 7th Bipartite Settlement) whereby instead of merger of Dearness Allowance at 1684 points the same was pegged to 1616 only and the same having been rectified only on 1.5.2005, has been the matter of judicial intervention and have been decided on 13.2.2018 by Hon’ble Supreme Court of India, by the Bench comprising of His Lordships viz: Hon’ble Justice Shri Arun Mishra and Hon’ble Justice Shri Amitava Rai, the operative part of which reads as under :
“Thus, we set aside the judgment rendered by the High Court of Delhi and affirm that of High Courts of Karnataka at Bangalore and the High Court of Madras. The appeals filed by the Banks are dismissed and the appeal filed by the Association is allowed. Resultantly, let the amount which was due and payable be paid with 9% interest, be calculated and paid within four months from today”
5. Since, I became eligible to receive the pension from _______, the arrears of revised pension based on the aforesaid Judgement for the period _________ to 30.4.2005 i.e. for _____ months along with the interest @ 9% p.a. calculated thereon is to be paid to me on or before 12.6.2018.
6. You are advised to make payment under information to me of the aforesaid accordingly by credit of my Pension account maintained with ______ Branch of the Bank wherein my pension is being credited.
