COMMENDABLE ! THE EFFORTS OF OUR FRIEND - VIZ: SRI M . S . SIDHU , AN OBC-RETIREE, WHO HAS BEEN ON HIS CRUSADE AS AN "ONE-MAN-ARMY" FOR THE CAUSE OF THE FRATERNITY OF BANK RETIREES. WHILE CONGRATULATING COM. SIDHU FOR HIS VALIANT EFFORTS WITH COURAGE, CONVICTION AND COMMITMENT, I REPRODUCE HIS LATEST COMMUNICATION ( dtd.07 05 2018) ADDRESSED TO THE REGISTRAR OF COMPANIES & ADJUDICATING AUTHORITY; MUMBAI -- CONTENTS ARE SELF -EXPLICIT.
IT MAY NOT BE OUT OF CONTEXT IF I REITERATE MY STANCE THAT.....
" We are forced to necessarily bank upon the time-consuming legal recourse which needs to be expedited simultaneously together with other organisational efforts like dharnas, CLC meetings, etc. In this regard, the pains-taking efforts of the leadership of All India Bank Retirees Federation- AIBRF, an apolitical organisation representing us , who have been making their relentless efforts unmindful of the humiliating/frustrating experiences at the behest of IBA and UFBU - The sole architects and copyright holders of their so called "Magnacarta" - ie. "Record Note" of 25th.May, 2015 in their bid to make us to stand before them as "beggers". Thus, we have been treated as “untouchables” both by the IBA and the Unions as well. Thus, we have been left with no other option but to knock the doors of justice for the redress of our legitimate grievances – -though burdensome, frustrating and time consuming." Being the signatories to the "historic "record note - the so called "Magna Carta", both IBA and UFBU have jointly stepped into the same shoes as our enemies creating "Road Blocks" in our struggle for justice. This letter of Sri Sidhu , assumes lot of importance and very much pertinent in the wake of the negative role being played by IBA/UFBU much detrimental to the interests of the Bank Retirees as a whole. I once again congratulate Sri Sidhu for his valiant efforts in this regard ....
Let us extend all our support in this behalf......

Respectfully, it is submitted as under: 1. That Indian Banks Association(UNREGISTERED) having its office at 6th Floor, Centre-
1. Building, World Trade Centre Complex, Cuff Parade, Mumbai - 400 005 is having 253 members from whom it receives membership fees and consultations fees for providing services to its members. Its members include Public Sector Banks, Private Sector Banks, Cooperative Banks, State Financial Corporations, etc. List of members, as extracted from the website of the Indian Banks Association, is enclosed herewith as Annexure-A.
2. IBA is charging Basic annual subscription from its members for providing consultancy services for the whole year. (AN ACT OF GAIN)
3. IBA negotiates wage revision of employees/officers of member Banks with Trade Unions on behalf of member Banks on regular basis for the last so many years. For this IBA charges the member banks heavily as negotiating Fee. (AN ACT OF GAIN)
4. IBA is collecting Special Fixed Asset Building Infrastructure Fund from members @20% of Basic Annual Subscription. IBA is a nonlegal entity and can not have any infrastructure in its own name. Yet it is collecting the FUND from banks. Annexure-D shows all the proof of fees and funds collected by IBA from all members. (AN ACT OF GAIN
5. That the subject Association is earning handsome profits by selling its magazine under the name of ‘The Indian Banker ‘Subscription rates of the said magazine are attached herewith as Annexure-B. (AN ACT OF GAIN)
6. That the subject Association has also published 99 books and earning handsome income from the sale of these publications. List of books published by it is enclosed herewith as Annexure-C. (AN ACT OF GAIN)
7. That the subject Association is a profit earning entity and has been functioning in violation of section 11 of the companies act 1956 & section 464 of the Companies Act, 2013, without getting itself registered with the Registrar of Companies and without paying the necessary registration fees
8. That the Indian Banks Association and its members are liable for fines as envisaged in section 464(3) of the Companies Act, 2013 for violating the provisions of the said Act. All these are acts of gain which are not only prohibited but are also punishable under Indian company act 1956 and 2013.
It is prayed that action under section 464(3) of the Companies Act, 2013 be taken against Indian Banks Association and its members for violating the provisions of the Companies Act, 2013 AND STOPPED FROM DOING ACTS OF GAIN FROM NOW ONWARDS.
The complaint registration number be intimated and progress towards satisfaction of complaint be intimated.

My Dear friends,
Working Unions will never fight this way.... They have "secret code" of Understanding that neither of them would knock the doors of justice in resolution of any dispute.
Only way out is to take recourse of the provisions of the ID Act.
But Officers organisations will not come within the purview of the ID Act., as they are not the signatories to the settlements under the ID Act.
IBA is exploiting this situation to their advantage:
EX: (modus operandi )
IBA signs the settlements under the provisions of the ID Act with the workmen organizations ( Notwithstanding to the understandings already reached between the Officers organisations on certain issues)
Thus, manipulating certain clauses , the final settlement will be signed under the ID Act. Ultimately making it a 'FAIT ACCOMPLI" to others members/constituents of the negotiating team of UFBU.
THUS ALL THE OFFICERS ORGANISATIONS / MINORITY WORKMEN ORGANISATIONS HAVE BEEN TAKEN FOR A “RIDE” BY IBA WITH THE SUPPORT OF THE MAJOR WORKMEN ORGANISATIONS….
In the process, they resort to "Manipulations" to safe guard their mutual interests Thereby bringing disparity/discontement among the working class as a whole.....
Finally the entire exercise would culminate into -"ROB PETER TO PAY PAUL" -
