The Issue

My significant other was released from prison in June 2024 and was set to have his parole finally terminated in October 2025. However, his parole officer abused his power, making a personal decision that led to my partner's unwarranted re-incarceration. This officer tampered with paperwork sent to the board of pardons, directly causing my partner to be unjustly imprisoned until September 2026. He is not scheduled for a hearing, and the disposition provided is neither true nor legal.

This isn't just a single, isolated incident; it is indicative of a systemic issue within the Utah Department of Corrections. Adult parole and probation officers must be held accountable for their actions—or lack thereof—particularly when their failures lead to wrongful imprisonment. Currently, there are no stringent repercussions for officers who neglect their duties, which results in individuals like my partner being trapped in the system without just cause.

Evidence from multiple studies, such as those conducted by the [Bureau of Justice Statistics](https://bjs.ojp.gov/ highlights the need for thorough checks and balances within the parole system. According to data, errors in probation and parole processes can lead to long-term detriments affecting not only the individuals involved but also their families and communities.

To address this issue, we propose the creation of an independent oversight committee specifically tasked with reviewing cases where misconduct by parole and probation officers is alleged. This body would have the authority to investigate claims, ensure transparency, and recommend appropriate disciplinary actions against any officer found guilty of malfeasance. Additionally, regular training sessions should be mandatory for all officers to foster ethical conduct and compliance with legal obligations.
