The Issue

We, the undersigned, call upon the state of Oregon, Multnomah County officials, and relevant authorities to address and correct the mishandling of court records and the subsequent violation of constitutional and civil rights. This petition is especially urgent for individuals with genetic disabilities, trauma-induced conditions, and other vulnerabilities who face systemic barriers within the legal system.

Overview:

The current state of court record management in Multnomah County has led to the mishandling of vital records and has disproportionately affected those with genetic disabilities or trauma-induced conditions. These individuals often face heightened challenges in I navigating the legal system, which should be just and accessible for all, but has proven to be a source of harm and confusion for many.

Violation of Constitutional and Civil Rights:

Access to Justice: The mishandling of court records obstructs fair access to justice. It prevents individuals from accessing crucial information about their legal cases, impeding their right to due process as guaranteed by the U.S. Constitution.
Discrimination Against Vulnerable Individuals: Individuals with genetic disabilities or those suffering from trauma-induced conditions often face difficulties understanding complex legal jargon and procedures. The failure to provide accessible and understandable documentation exacerbates their vulnerability and compounds their struggle for fair treatment.
Right to Fair Representation: All individuals, regardless of their background or health status, deserve competent legal representation. The improper handling of records impedes the ability of attorneys to adequately represent their clients, undermining the right to a fair trial.
Increased Mental and Emotional Burden: For individuals with disabilities or trauma histories, the lack of proper records and transparency exacerbates the emotional and psychological burdens they already carry. Such mishandling often results in unnecessary stress and confusion, further victimizing those already marginalized.
Call for Reform and Transparency:

We demand that the Multnomah County judicial system take immediate and meaningful steps to ensure:

Accountability and Correction: Those responsible for mishandling court records be held accountable and proper measures be implemented to rectify these failures. All affected individuals must be given access to their correct court records and assurances that such issues will not persist.
Accessibility for All: Court records, legal procedures, and documents must be made accessible to all individuals, with special attention to those with genetic disabilities or trauma-induced conditions. Legal proceedings should be simplified, and resources for assistance should be made available for those who need extra support.
Internal Reform: Multnomah County must initiate an internal review and overhaul of its processes for managing court records, focusing on transparency, security, and efficiency. Clear protocols for handling sensitive information must be established to ensure future mistakes are prevented.
Ongoing Monitoring: An independent oversight body should be established to monitor the handling of court records, ensuring ongoing accountability and the protection of civil rights for all citizens, especially the vulnerable.
We, the undersigned, urge the appropriate authorities in Multnomah County and the State of Oregon to take immediate action to correct these systemic failures and guarantee the protection of constitutional and civil rights for all citizens, particularly those with disabilities and trauma-induced conditions.
