Hold caregivers in California accountable for fiduciary misconduct
The Issue
The devastation of the 2018 Paradise Camp fire marked a turning point in my family's life, as well as the lives of several evacuees. Among those affected were my parents, whose dreams were dashed and whose lives were tragically shortened without ever receiving the compensation they deserved. Throughout this ordeal, I frequently engaged in heartfelt conversations with Terry, a courageous man who escaped the flames with his dog, Toby. Together, we navigated the complex emotions, from laughter to moments of profound intensity, that accompanied our biweekly visits.
However, amidst these personal connections, I could not ignore the glaring inadequacies in the empathy shown by caregivers at assisted living facilities and board and care homes. Time and again, I documented complaints voiced by my loved ones and others who sought my assistance, sharing these concerns with facility managers. Sadly, such grievances remained largely unaddressed, underscoring a profound lack of accountability among caregivers.
A particularly troubling issue is the fiduciary misconduct rampant within these facilities. It often involves an employee or former employee accepting the role of executor for a patient, only to exploit this position for personal gain. This breach of trust occurs far too frequently, with caregivers posing as compassionate confidants while secretly driven by greed. Such actions betray the Hippocratic Oath, ultimately harming the very individuals they are supposed to protect.
In light of these injustices, we call for urgent reform in California's assisted living facilities and board and care homes. We demand stricter regulations to ensure that any caregiver or employee taking on fiduciary responsibilities is held accountable for their actions. All potential executors should undergo comprehensive background checks and mandatory training on ethical obligations, providing transparency and trust for the vulnerable individuals they serve.
It's time to take a stand against fiduciary deceit within these institutions. Protecting our loved ones from exploitation is not only a moral duty but also a legal and ethical imperative. Together, we can make a difference. Sign this petition to urge California's lawmakers to enforce stricter accountability measures and safeguard the rights and dignity of those in assisted living facilities.
