We, the homeowners and residents of Georgia, urge our State Legislature and Senate to enact comprehensive reforms in the operation of Homeowners Associations (HOAs). Numerous Georgians have borne the brunt of unchecked HOA powers. We need a system characterized by transparency, fair governance, and rigorous accountability mechanisms that upholds homeowners' rights.

 
Key Points for Reform:

1. Outside Oversight for Finances: An independent external entity should monitor HOA finances, ensuring transparency and curbing potential mismanagement. 

2. One Position Per Household: Leadership roles should be limited to one position per household for a diversified representation.

3. Transparent Budget & Expenditures: Every homeowner deserves unfettered access to detailed accounts of the HOA's budget and expenses.

4. Eliminate Quorum Requirements: Abolish quorum requirements to ensure every decision genuinely reflects community wishes.

5. 80% Agreement on Changes: Major community changes should see agreement from at least 80% of the community, irrespective of participation rates.

6.Fair Grandfathering Provisions: Allowances or exceptions granted to one homeowner should be made available to others in analogous situations.

7.Limit Dues for No-Common-Area Communities: HOA dues for communities without shared spaces should be rational, reflecting genuine management costs.

8.Right to Opt Out: Communities should possess the right to leave their HOA if the overseeing builder goes insolvent.

9.End Fine and Fee Implementation: HOAs should not possess the power to impose fines and fees, ensuring homeowners' autonomy over their properties.

10.Personal Accountability for HOA Leaders: Unjust targeting or harassment by HOA leaders should result in fines or, in severe situations, imprisonment.

11.Statewide HOA Watchdog: A dedicated statewide committee should address HOA complaints to ensure swift and equitable resolutions.

12.Transparency in HOA Leaders' Requests: Changes or ACC requests by HOA leaders regarding their properties must be publicly accessible, ensuring no preferential treatments.

13. HOA Leaders as Exemplars: Board members' properties must be exemplary models, representing the community's covenants and bylaws with minimal deviations and special requests.

14.Statewide Dues Payment System: Introduce a statewide system or office where HOA dues can be submitted, further promoting transparency and honesty.

15.Standardize HOA Regulations: The state should curate a standard list of regulations that HOAs can enforce, such as lawn maintenance, to eliminate subjective and personal opinion-based violations.
