The Issue
To: All Resident Members of the Hillcrest Terrace Owner's Association
Subject: Recall Petition to Remove the HOA President and dissolve the board to create a new HOA board of Hillcrest Terrace Owner's Association
Dear Fellow Residents,
We, the undersigned members of the Hillcrest Terrace Owner's Association (HTOA), are writing to express our collective concerns regarding the conduct and performance of the current HOA President. It has become increasingly clear that the actions of the HOA President are detrimental to the well-being of our community and do not align with the best interests of the residents. Therefore, we propose a recall of the HOA President from their position and dissolving the HOA board such that a new board could be formed.
The following are the primary reasons for this recall petition:
Ill-treatment of Residents: The HOA President has been consistently ill-treating fellow residents. Multiple instances have been reported where residents have faced rude, dismissive, and disrespectful behavior during interactions.
Ignoring Resident Requests: Numerous requests from residents regarding various community matters have been ignored or unduly delayed. This includes maintenance issues, community concerns, and other important matters requiring attention and action.
Delays in Architectural Approvals: The process for approving or rejecting architectural changes has been excessively prolonged under the current HOA President’s leadership. This has caused significant inconvenience and frustration among residents seeking to make improvements to their properties.
Autocratic Decision-Making: The HOA President has been making unilateral decisions, often siding with the HOA property manager without consulting or seeking the vote of the board. This lack of transparency and disregard for proper procedures undermines the democratic principles of our association.
Unjust Fines and Threats: There have been several instances where the HOA President has imposed undue fines and issued threats to residents without proper justification. These actions have created a hostile environment and fostered a sense of fear and resentment within the community.
We believe that the removal of the current HOA President is essential to restore trust, transparency, and a sense of community within Hillcrest Terrace. To proceed with this recall, we need the support of our fellow residents.
By signing this petition, you are expressing your support for the recall of the current HOA President. We aim to gather the maximum number of signatures to initiate the recall process although the requirement is just 5% of the resident members as per California HOA law because the Hillcrest Bylaws doesn’t have any mention of a recall petition by members and the percentage of votes required so the California state law prevails here specifically the California Davis-Stirling Common Interest Development Act that addresses the removal of board members, including the president, is found under Civil Code Section 5100 et seq. This section outlines the process for recalling board members by the membership, which includes gathering signatures from at least 5% of the HOA members to initiate a recall.
