

NY States laws need to change! Remove the financial factor from Wrongful Death!!
The Issue

He and Kaycie's mother Brittani, both are hard working, loving parents, both of who are attending school, and have military history. James to my knowledge, is still serving in the Army Reserves. On January first, 2016, the couple gave birth to a little girl, Kaycie Anne Beaver. What better way to ring in the New Year!Tragically, just 14 weeks later, Kaycie passed away while she was at her baby sitters. The sitters were friends of James and Brittani for some time, and thought they could trust them with their daughter. Neither parent was aware of the history that these people had, with CPS, for a history of abuse and neglect. Kaycie's death has been ruled an accident, though clearly, under the circumstances it is anything but. At the very least, there should be charges of negligence, but the local police, and DA won't file charges, or help in any way.

After the accidental death ruling, the James and Brittani sought a civil suit against the sitter. This is the response that they received, as described by the mother.
"Spoke to the attorney in Syracuse.... Because Kaycie was an infant and ny's wrongful death statutes don't really do much for babies and elderly- because suing over a wrongful death here is more about economic loss to the family over the death... And a baby doesn't financially contribute to a family so there's really no economic loss. And it was an illegal daycare operation, and they likely don't have renters insurance anyway and it wouldn't payout over the death of an infant in this situation... We have no civil case apparently. Its all on the criminal Justice system to do something..."
I am asking for you help, in getting these laws changed, or a new law written, that will prevent this from ever happening to another couple, and ensuring that negligent, uncaring, irresponsible people such as the sitters face consequences for their actions. The loss of a life should not be broken down to financial cost.
Kaycie's death could have been prevented. This sweet little girl did not have to die, and her parents do not deserve to suffer through such a painful, preventable ordeal. We need tougher laws, and more scrutiny, governing child care when it comes to day cares, even when it's a on a smaller scale. When you take on the task of watching over a child, you assume responsibility for that childs life. When something like this happens, the people who were promising to protect, and failed, need to be held accountable. This includes CPS and law enforcement for failing to ensure that these people never had access to another child.

When the legal system fails, and the matter is left unresolved, a wrongful death case should not be centered on financial loss, when the victim wasn't even in a position to contribute financially! Re-write the laws, so filing Wrongful death re-opens the case, forces another investigation, by another agency if need be and allows for the guilty to be held accountable for their actions!
Help James and Brittani get justice for their little girl, and prevent other families from suffering as this family has!!
UPDATE Unless Kaycie's toxicology comes back abnormal, nothing is going to be done. Because there is no money in it for the attorneys, the family can't get any help because these lawyers won't be paid. The fact that money has become a factor in death, that money...paper, of all things, is valued over a life, A BABY'S, ANY LIFE is a complete failure on the part of NY State. This is what is wrong with society. Things are valued over people. It needs to change. Loss of life should not be swept under the rug because of money. This was no accident, this was clear and obvious neglect, and the guilty parties NEED TO BE HELD ACCOUNTABLE FOR THE DEATH OF A 14 WEEK OLD BABY!!This family, and their sweet little girl aren't getting justice for the obvious neglect, and lack of care, because the guilty party isn't rich.
