Protect veterans service connected disability compensation from civil courts
The Issue
Pennsylvania veterans are being stripped of their service connected disability compensation everyday by civil court judges. Veterans are being forced to pay over more than half of their benefits to able bodied non-veterans with complete disregard to federal laws.
38 U.S. Code § 5301 - Nonassignability and exempt status of benefits
Payments of benefits due or to become due under any law administered by the Secretary shall not be assignable except to the extent specifically authorized by law, and such payments made to, or on account of, a beneficiary shall be exempt from taxation, shall be exempt from the claim of creditors, and shall not be liable to attachment, levy, or seizure by or under any legal or equitable process whatever, either before or after receipt by the beneficiary
Title 38 Defines the Following as:
The term ‘‘service-connected’’ means, with respect to disability or death, that such disability was incurred or aggravated,or that the death resulted from a disability incurred or aggravated,in line of duty in the active military, naval, or air service
The term ‘‘compensation’’ means a monthly payment made by the Secretary to a veteran because of service-connected disability.
