Hello, I am seeking help for my brother Luciano, who is disabled. My brother has Down syndrome and turns 21 in August. Under the current law, turning 21 means he is no longer considered a family dependent, and this automatically threatens his legal status, despite his disability.

This presents a grave concern for our family because, due to his mental disability, it is extremely difficult to find a suitable visa for Luciano. The majority of visas available rely on employment or academic pursuits, neither of which accommodates his situation. Given that there is no legislation which acknowledges the need for individuals like Luciano to remain dependents due to disabilities, we find ourselves in a distressing and challenging position.

It's essential that our immigration laws evolve to recognize the unique needs of individuals with disabilities, ensuring that they continue to have legal protection as dependents even after turning 21. Luciano is a beloved family member who deserves to continue his life in a supportive environment, without the looming fear of losing his legal status.

We are calling on the relevant authorities to amend the existing immigration laws to make a provision for individuals with disabilities who cannot meet traditional visa requirements due to their condition. This might include implementing a special visa category that allows dependent status for those who have lifelong disabilities, irrespective of their age.
