Always Remember- ⚖️Who Voted For and Against HB837. ❤️While our issue to allow patients to sue health insurance was mostly resolved, this law significantly limits the rights of all Floridians and the legislature sadly used ads to vilify attorneys that work hard to defend and stand up for the disadvantaged. I watched constituents speak up against this law in Tallahassee & sadly, most representatives did not listen to their constituents. This is a huge win and give away to all insurance companies. However, I do want to recognize my State Representative Alina Garcia, because she listened to my concerns and spoke to the sponsors on my behalf and set up a meeting so we could speak to Rep. Gregory about the concerns because she recognized that patients needed to have a vehicle, as Rep Gregory did, to go after insurance if coverage is improperly denied. They carved out an exception, and for this we are grateful. Nevertheless, I cannot ignore the disappointment I feel that so many representatives did not listen to their constituents and that the house chose to vilify attorneys to fast track a bill that curtails so many rights, rights that do not belong to attorneys, as stated by NFIB Executive Director Bill Herrle in this article where he says the law brings the “scales of justice back into balance after being weighted in favor of plaintiffs’ attorneys for so many years,” Herrle is wrong, the rights taken away belong to Floridians, small businesses, everyday residents, and those that are clients. These rights do not belong to the Attorneys, Attorneys are simply the tool used at the direction of their clients to achieve Justice. The House voted to curtail the rights of every single Floridian with this bill.
