Help End Medical Kidnapping & Enact Medical Neglect - Bills Proposed

The Issue

Medical kidnapping is defined as a wrongful removal of a child (minor under 18 years of age and/or vulnerable adult) from their parent/guardian by law enforcement, social worker and/or any other official, upon:

    * When a parent/guardian questions or denies a potential medical treatment and/or test for a child/vulnerable adult or chooses to seek a second opinion when there is cause for concern that the potential medical treatment would do harm to the child/vulnerable adult, including but not limited to an allergic reaction; or 

    * When a parent/guardian brings their child/vulnerable adult in for medical treatment or care, and a child abuse/neglect screening has established there is no child abuse/neglect and the child/vulnerable adult is removed and/or placed in state care by social worker, law enforcement and/or any other official, at a treating hospital and/or any other medical treating facility, for invalid reasons, including but not limited to imminent harm and/or danger.

Medical kidnapping occurs mostly in hospitals where Child Abuse Specialists are employed/volunteer. These specialists are making false statements, which allows law enforcement and social workers to remove children/vulnerable adults from their parents/guardians, most of the time at the child's hospital bedside, leading to unnecessary legal issues such as child protection, family law and criminal cases.  

It has been stated by a Master Social Worker where a Children's Hospital Psychiatrist agreed, that if the child/vulnerable adult has a medical reason (including but not limited to Influenza, Celiac, GI issues, or a compromised immune system), and is being treated for the issue, then child abuse/neglect shall not be deemed; no further social work is warranted; and no further investigation is to be obtained. However, both hospitalist doctors and child abuse specialists are disregarding their colleagues diagnosis, treatment and recommendations, and instead are taking it upon themselves in making false CPS claims and police reports. 

Parents and guardians continue to have their children/vulnerable adults wrongfully removed from their care and deprived of their constitutional rights, unless this bill becomes statute. 

This bill will help end medical kidnapping. The other bill being brought forth is defining what is and what is not medical neglect. 

It is for these reasons and more that we ask for your support by signing this petition, sponsor or co-sponsor this bill to help end medical kidnapping, define medical neglect, uphold the constitutional rights of individuals and remain steadfast in securing and protecting the sacred bond between a parent/guardian and child/vulnerable adult.
