The Inspector appointed by the Secretary of State for Environment, Food and Rural Affairs in assessing evidence submitted by Harrow School, used what we are told is quite strong language for an Inspector. Please see the following quotes.
Exaggeration.
Paragraph 45 “ It seems to me that none of the problems to which the School refers in relation to the part of the footpath which passes between the astroturf pitches are significant.”
Paragraph 52 “I consider that many of the benefits of the diversions put forward by the School are over-stated.”
Aggressive stance from Harrow School (supported by the Council ) but the Inspector stood up to them.
Paragraph 68. “The School submits that this “fallback position” should be taken into account in any consideration of the effect on public enjoyment. The Council agrees with this submission.”
Paragraph 69 ..it is difficult to accept that….
Paragraph 71 “It seems to me that the fallback position presented to me is far from inevitable.”
Paragraph 112 “ I do not accept that it is an inevitable, or even likely, consequence…..”
Misleading / contrived understanding perhaps?
Paragraph 101 “It is difficult to accept that the School did not understand the position…..”
Dismissive of alternatives - sound familiar?
Paragraph 70 “ .. the School had considered possible alternative routes, including the Eley Route12 and possible re-configurations but that none of these was in its view practical or feasible. “
The Inspector dismissed this.
Paragraph 112 “Nevertheless it is clear that the School could propose a different diversion..”
Finally, it is worthy of note that despite the School claiming due process and taking account of all the objections and representations made, the Inspector decided in favour of the public (the objectors). Perhaps a more genuine collaboration would have helped to find a solution? Numerous examples of similar presentation used by the School are to be found in the application for the sports hall and conference centre. Here we are still able to work together on a better Brownfield solution which minimises the impact on MOL and yet delivers the facilities.
