
Hello everyone,
Following the initial phase of the petition, we deliberately paused further international promotion for a period of time. During this phase, we focused on local dialogue and hoped that practical improvements to the current system could be achieved without the need for escalation.
However, despite these efforts, the core issues affecting independent kayakers remain unchanged. For this reason, we are now considering a renewed and more structured legal approach.
This message is to explain clearly what the main concerns are and what kind of actions may be considered.
1. Current situation
Based on ongoing observation and direct feedback from private kayakers, several critical issues remain:
mandatory fees are applied specifically to kayakers for accessing the river
the same areas can be freely used by others (walking, swimming, picnicking) without any charge
access points are often natural and do not require dedicated infrastructure
administrative rules and time restrictions are limiting normal river use
penalties remain extremely high in relation to the type of activity
This creates a situation where access to a public river is effectively conditioned by the type of activity, rather than by the use of shared infrastructure.
2. Key objective
The objective is not to eliminate regulation, but to move towards a system that is fair and consistent for all users.
A key proposal under consideration is:
shifting from activity-based river access fees to a parking-based system, where all users contribute equally through the use of parking areas
This would:
remove discrimination between different types of visitors
simplify the system
maintain a sustainable source of revenue
align more closely with how public access areas are managed elsewhere
3. Specific concerns
In addition to the general system, there are also specific points that require attention:
the closure of the so-called “Katarakt” section, despite its long history of safe use by experienced kayakers
time restrictions on the section between Srpenica and Trnovo, currently limited to 18:00, which significantly reduces the usability of the river
These elements are seen as disproportionate and not aligned with the actual use and safety record of the river.
4. What is currently being developed
We are currently working on a structured evaluation of the legal and administrative framework behind these measures.
The aim is to assess whether a formal request for revision can be supported on the basis of:
equal treatment
proportionality
lack of infrastructure justification
overall consistency of the system
5. Why collective support may become necessary
If this process moves forward, it will require:
legal expertise and consultation
preparation of formal administrative actions
technical documentation and evidence
possible legal proceedings
For this reason, we are considering the creation of a transparent, community-supported legal fund, dedicated exclusively to these purposes.
6. What such a fund would be used for
Any future crowdfunding initiative would be clearly structured and limited to:
legal analysis and advisory support
administrative and regulatory procedures
documentation and case preparation
transparent reporting to the community
