Petition updateHalt the Construction of a Massive Warehouse in ModenaProtect the American Woodcock

I would like to notify everyone that I was contacted by an official a few months back who had concerns over possible nesting grounds of the American Woodcock at the location site of the Warehouse. Upon returning home one day, my son and I noticed the distinct call of the American Woodcock emanating from the vicinity of the proposed Warehouse property. We decided to capture a video of the property, including the back of our house just to easily confirm the location.

As we stood at the edge of the woods, the very clear and recorded birdcall provided evidence that the American Woodcock migrated into that area. To validate our findings, we compared the call to online recordings of the Woodcock leaving us with no doubt about its identification. Additionally, we noticed two more Woodcock calls originating from outside of the Warehouse property. Far off in the opposite direction.

I have sent an email to the official with recordings attached.

Best regards,

Patrick

Some information about the American Woodcock.

The MBTA and American Woodcock Protection

The Migratory Bird Treaty Act (MBTA) provides a broad level of protection for the American Woodcock across the country, including in the NY state region. The MBTA is a federal law that makes it illegal to pursue, hunt, take, capture, kill, or sell migratory birds, their eggs, or nests, except as permitted by regulations.

Protection under the MBTA

The American Woodcock is protected under the MBTA as a migratory bird. This means that it is illegal to harm, kill, or possess the species without a permit. The law applies to both intentional and unintentional actions that result in harm to the bird or its habitat.

Habitat Protection

The MBTA also protects the habitat of the American Woodcock. This includes areas used for breeding, feeding, and migration. The law prohibits activities that destroy or alter these habitats, such as land development, logging, and mining.

Penalties for Violations

Violations of the MBTA can result in significant penalties, including fines and imprisonment. The U.S. Fish and Wildlife Service enforces the law and investigates reported violations.

State-level Protection

In addition to federal protection under the MBTA, the American Woodcock is also protected under state laws and regulations in New York. These protections may include additional restrictions on hunting and habitat destruction.

Conservation Efforts

Conservation efforts for the American Woodcock are ongoing at both the federal and state levels. These efforts include habitat restoration, population monitoring, and research on population trends and threats. The MBTA plays a crucial role in these efforts by providing a legal framework for protecting the species and its habitat.
