Halt the Approval of Safety and Land Reuse Ordinances Threatening Private Property Rights

The Issue

As a resident of Nicholas County, I am deeply concerned about a proposed ordinance currently being discussed by our county commissioners. This ordinance has the potential to endanger the private property rights of individuals across the county if our properties are deemed unfit or an “eye sore.” The wording is too vague to be safe for the citizens of this county. Let's also point out the timing of the public meetings which is not a reasonable time for the general public to even attend.


The proposed safety ordinance, under the umbrella of land reuse, if passed, would provide county commissioners with considerable power and discretion over decisions surrounding private property. Local homeowners may be targeted unfairly, and their properties, which for many represent a significant investment, could face devaluation or even seizure. Let's not forget that we have a county commissioner involved in real estate.

In the wrong hands, these ordinances can impose fines and punitive actions against homeowners based on subjective criteria and may lead to unnecessary financial burdens on families. According to a study conducted by the Institute for Justice, nationwide lawsuits regarding code violations have risen significantly in the last decade, imposing harsh penalties on property owners and filling government coffers unfairly.

As citizens of Nicholas County, we have the right to own, use, and maintain our properties without fear of unpredictable and subjective regulations. We urge our county commissioners to reconsider the proposed safety and land reuse ordinances and protect the private property rights of the individuals they were elected to represent.
