In all the research I continue to do, I found this interesting tidbit of info. A lawsuit in New Mexico concerning UIM offset laws. Granted its NEW MEXICO , not Wyoming and we don't carry coverage nor DL license in NM but found it interesting that a lawsuit developed and won.  Couldn't copy and paste site so just took body of article.


"Nationwide Mutual Insurance Co. and its affiliated companies agreed to pay $2,650,000 to settle a class action lawsuit alleging they failed to properly inform New Mexico policyholders that underinsured motorist claims would be reduced by the amount paid by the at-fault driver’s insurer — an practice known as the “Schmick offset.” New Mexico residents who held a Nationwide UM/UIM auto policy or had a UIM claim offset between October 1, 2010, and March 31, 2022, may be eligible for up to $25,000 in compensation or an automatic partial premium refund. Offset subclass members must file a claim by March 30, 2026 — 19 days from today. Other class members do not need to act: their premium refund will be sent automatically."

Several class action lawsuits took place in NM claiming insurance companies failed to explain its offset procedures to NM policy holders resulting in illegal offsets that reduced their uninsured motorist protection. One large insurance company settled for $20.93 MILLION. Another $2.65 million. Another $1.2 million. The list goes on. These types of payouts trickles down to consumers. Let's change Wyoming's law before it happens here.
