Make ‘Causing serious injury by careless driving’ applicable to outstanding cases

The Issue

Families have been suffering from the injustice in law regarding The Road Traffic Offenders Act 1988 where a offender can be charged with either ‘Causing serious injury by dangerous driving’ or simply ‘Careless driving’ with no middle ground for drivers that cause serious injury through carless driving. This means that many, many cases presented to the CPS as ‘causing serious injury by dangerous driving’ get down graded to ‘careless driving’ meaning that the correct justice is not served. 

On a positive note, the government have now recognised and I quote ‘this gap in the law’ when it comes to this matter. 

For families such as ours, who currently have cases outstanding and not yet heard in a court of law, we ask that our Home Office enables a fair charge in these cases and thus enabling a fair justice, that the victims deserve. 

Our MP is in receipt of this complaint and sending our case to the Home Office. Please, there are many, many Families suffering at the hands of outdated laws, before October 1st 2020 we would never have known about these laws and now from our own unfortunate experiences, we want families suffering across the UK currently to have access to the correct justice for themselves and loved ones.
