NOW after a quick look at the past. 

IN 1995, I started to live in my HOME flat. 

IN 2007 I was able to breathe thanks to a machine, my lungs had collapsed . 

I could breathe in but the machine was helping me to breathe out the air I was taking in. I had an operation prior to that but instead of improving, it made matters worse. 

Sitting in hospital, day and night,  night and day with the will to breathe in and out but my lungs not budging, I had no idea how I would survive . 

I could have died at least twice working with MSF, but if death missed me in those years , it was by accident . This time I had to break free. 

Perhaps it was the desire to stand up for my rights after trying to defend other people's rights in my work that made it happened, I do not know, but I was able to leave the hospital with a simple tube and bag to help me breathe until my lungs worked again on their own even though I have sometimes relapses. 

This time of the year is a time for Peace and Love for all of us but more for the few. It is just what life is about . Is it ? 

Back to today . I received a reply from the « usurped «  landlords and here is the translation. 

1. " Hi, we all bought a part of the share of the freehold and here is your share in name only and we added our 999y to the lease but in your case we decided you would have to pay another 6 figure to get your lease. 

YOU do understand that we are not from the same class . "

2. " With regard to the - right to manage company- that you created to replace the managers from the previous freeholder, my mate , we decided to keep his managers  and to change that right to manage company as my first business company before creating my second one. 

YOU do understand  that you have no need for that not being a business person"

3. "With regard to the specific disrepairs at your flat home since 1995, we have decided that a bit of leak, damp, extreme weather exposure for years should not have made you sick unless you are predisposed genetically. 

YOU do understand that we cannot do anything if you are weaker than us and it is not our fault because we did not know. At the end of the day the lawmakers are  allowing us to do whatever we want with your home"

4. "With regard to the damages done to your flat from 2014-15 building work and ongoing changes after, including damages due to flooding , we were ready to help but your desire to have all the damages looked at was too much

YOU do understand that the loopholes in the law that the lawmakers leave for us are ours to grab "

"In short you are not from our class, do not speak as well as we do, you are not a business person and of any value. You are weak and it must be genetic, the law is always on our side because it knows we are superior. 

This is not racism, fraud or theft, it is a fact of life.

Because you are standing for your rights , we will now take all what you have left, health and the rest of your home.  Because we are the LAW. "

That was it , they summarise in a short and sweet way my 30 years of life at home under their rule. WELL I DISAGREE AND DO NOT UNDERSTAND . ACCORDING TO THE LAW OF ETHICS AND INTEGRITY WHAT THE LANDLORDS DID IS UNLAWFUL AND WHATEVER LOOPHOLE THEY USED SHOULD BE REMOVED. NOONE SHOULD BE ENTITLED TO PLAY GAMES WITH A LIFE OF ANOTHER ONE BECAUSE THEY CAN AND IT GIVES THEM A BUZZ.

IT IS CHRISTMAS , IS THERE A REFORMED MR OR MRS SCROOGE IN THE AUDIENCE TO HELP THE NECESSARY CHANGES NEEDED IN THE LAW ?

TWO generations of wait for the promised Changes are not the emblem or the Symbol of a DEMOCRACY. Is it ? 

WE SEE PLENTY OF LOUD VIOLENCE  and the sick feeling never goes away.

There is PLENTY OF SILENT VIOLENCE and your life is taken away slowly bit by bit, incrementally that you won't even notice until suddenly you won't have control over your own body and your own home . 

And the HUMAN RIGHTS  you thought you were entitled to will have been disposed of and ditched by someone who decided that entitlement was not for you, only for them. 

This is LIFE. Is it ? 

We always have the choice to make the right or wrong choices but not making a choice and standing still is not what LIFE is about . 

From all the different corners of this world to our island U.K. , we all aspire to the same rights and same value recognition . 
Exchanges  with my MP team about the legislators housing proposals show that the work is still to have it more finely tune to the real needs we face . 

My life is behind me and your life is still on its way , this is why I thank you for the support you have provided to my cause so far and for the help you may be willing to in the future . 

From the narrower basis of my case , my home value loss , my total dismissal for proper repairs , the home damages set and made with complete impunity, I pledge for the remaining of my time allegiance to the respect of housing rights, to bring the necessary vital changes so that another family will not have to know the same fate . 

A feeling of participation to sustain the Health of our democracy . 
Is it not ?

Below Explanations requested by a reader : 

In 1995, I bought my home flat that needed lots of work and had disrepairs and a smaller roof with no protection at all and a leaky tank with asbestos sheets . That was my kitchen . 

The freeholder who from 1996 told me he was wealthy was not interested by my disrepairs and was a wealthy BBC director and his managers for the building were not helpful at all . 

I contacted the leasehold advisory service ( LAS) from 1998, they gave me the information on how to buy the freehold. I asked the 2 others in the building to join me because the freeholder had refused previously to share and without it , I could not have proper repairs.  After looking at the booklets from the LAS, I summarised the necessary 10 steps to apply to acquire the share of the FH, this included the 999y lease. We started in 2004 to apply. There were problems with solicitors making mistakes , creating delays and my own health made me hand the whole file to one of the 2 others who was very keen to take over and I trusted them ( she X and he Y ) fully. 

The targets set were 1. the share of the freehold (FH ), 2. the lease to set up at 999y, 3. the "right to manage company " to replace the managers , cheaper and more efficient to manage ourselves. 4. the unanimous vote following the advice from other group of shared freehold. 

Results we got : 

  1. The share of the freehold in November 2010
  2. Through the same solicitor we paid for , we were due to have the 999 y lease in January 2011 at the latest . The 2 others got their 999y lease .I got nothing and yet was not even reimbursed for what I paid. When you have the share of the FH, you only have to pay the fees of the solicitors to fill the papers for you, It was withheld. Until I accept to pay another 6 figures to the 2 others by a legal loophole I will have nothing. I am asking the law to stop this from happening. 
  3. The " right to manage " company , its purpose was scrapped by the 2 others who then transformed it into a business linked to the BBC to start with. I do not know these days what they do with it but it is not used as a "right to manage" company, the reason why it  was created . I am asking the law to stop this type of abuse.
  4. The same managers were kept instead of using the "right to manage  company". Not only did they never attend properly to my disrepairs from 1995, they will allow the extensive building works to happen above my flat from 2014-2015 creating the damages.... and the flooding is only the third flooding from the wealthy man. But having multiple houses in different continents , this wealthy man can be quite distracted. I am still waiting for the reimbursements and repairs to be done in view of the facts that I still have problems; from the extensive reconstruction of his attic , pied a terre, into a penthouse that I have never seen albeit the damages done to my flat. 
  5. Just after the purchase of the FH in November 2011, the leader of the shared freehold Y decided to join unilaterally the previous freeholder BBC one into a specific insurance and building insurance . This was one of the reasons I was forced to accept that the managers will be remaining and X, she always followed Y being his associate. The reasons why I wanted us to manage our house and it had been agreed unanimously before are that the managers were people who did not mind at all my disrepairs to be left with minimal repairs but minded any small wish from the BBC freeholder and were so expensive . They even thought I was renting in 1996 and had been unable to buy my flat as the BBC freeholder had been against it from the start ( from my conveyance solicitor ) 
  6. The unanimous vote (necessary to protect when proper repairs are needed only at one flat level in an old house ) was scrapped by X and Y   and that meant I never had my proper disrepairs attended as the managers were hopeless , as for 1995, the past freeholder kept on influencing Y and X in everything regarding the building with his BBC aura. The Law needs to look at this vital concept to protect from ganging and prevent it it from happening .
  7. There are the twists and turns and more that should not happen if the law is pragmatic and has  common sense, protecting the minority.  There will always be people like me , stupid and naive in trusting the wrong ones. It is the law that needs to change and shield us in our home . I had understood the profile of the first freeholder, he would remain a Scrooge for eternity and why the purchase of the shared freehold was a necessity. I knew the psychological profile from the influencer Y in the group. I had always tried to help him when he needed. But he became aggressive and his behaviour changed over the years and why I thought he wanted to show his control and power and then would allow me my disrepairs to be done . But it never happened. I had asked X his associate to help me when the behaviour of the one she followed changed but she did not do anything. I used to be belittled by the 2 but again during the pandemic I contacted X to explain to her what happened in these last 30 years what her passivity had allowed . Perhaps she had not understood fully. But the text above is a translation in a lighter way of her reply. I never thought I would see such depravity in the last 30 years as all this was made wilfully. The wealthy man and Y do not live there , only X but separately . 
  8. That is it . I missed having 30 years of comfortable life in my home ( I did slowly do some repairs , the ones I could do ) What I have left is an end of life and a duty to ask the lawmakers for the law to change. When I came back to England  after years of working in Africa and Middle East, I truly thought it was the land where everything was possible and an European civilisation mixing with other cultures where everyone had a chance to thrive . LOL 
  9. This is why our lawmakers either change the law and we can ask them to do that for us or we have to find the gene of naivety and the genes of greed and control over others and remove them from our DNA. Let's go for the easiest option . ? Even if my time is getting shorter, let's try for another year, HOPE is coming back for another 365 days ! Changes in housing rights thanks to your support . and my primitive IT knowledge.
