General Medical Council (GMC)  Reform Medical Act 1983 to Act 2022 :

 

We invite doctors and lay persons alike to sign this petition to improve health service. 

Over 100,000 signatures are necessary to ensure a debate in the House of Commons.

 

We, Health Professionals of all grades, believe reform of the General Medical Council (GMC) is essential to improve health care for patients and to save doctors and the vital services they provide to patients, from the undue harm caused by biased and often lengthy investigations, suspension and erasures.

 

Reform of the GMC, spurred by the Commons Health and Social Care Committee, and instigated by parliament, would restore fairness for those doctors who are brought before it.

 

There must be a return to the independence of doctors from political pressures, commercial interests, lobbying by ‘interest groups’ and other subversions of good medical practice. This independence must be sacrosanct. The ethical basis of medical practice must be recovered by safeguarding and re-instituting the freedom of a doctor to speak to and on behalf of their patients.

 

The GMC has powers to impose conditions on their practice, suspend or erase a doctor’s name from the medical register. This system was originally brought into being to protect the public from poorly performing or dangerous doctors but is instead being used to penalise experienced, hard working, honest, ethical and scientifically literate doctors who do not blindly follow political or medical narratives - the doctors who are actually putting the the mental and physical health and welfare of their patients first.    

 

The GMC has been using its considerable powers to impose conditions on practice and suspend doctors for overtly political reasons resulting in immediate loss of livelihood and frequently ruining not only their careers but also causing severe hardship to their families, especially their children. Many of those doctors affected belong to ethnic minorities, who are, in many ways, the back bone of the NHS .

 

The current adversarial GMC system does not protect the public nor improve medical practice, it merely serves to maintain the status quo. Doctors are seriously harmed when the GMC decides to conduct an inquiry at short notice without mediation or warning by the Interim Order Tribunal (IOT), or the Medical Practitioners Tribunal Service (MPTS). 

 

Whereas the GMC may take years to ‘gather evidence’ and ‘have reports prepared’ before deciding whether to proceed to a hearing or dismiss the case, meaning the doctor concerned may be unable to work causing them major financial hardship, the same GMC may nonetheless quite suddenly require the doctor to attend a hearing and produce their own witnesses and reports in a matter of weeks, massively handicapping the chances of the doctor presenting a successful defence and further stressing them to almost breaking point. Indeed it can feel as if the long and laborious GMC investigations are purposely strung out to increase duress.

 

Some doctors leave the profession altogether. Many leave the country, suffer mental distress or actual mental illness. Some commit suicide. 

 

Meanwhile the GMC still fails to protect the public from harm. Many doctors are so engaged in ‘box ticking’  to protect themselves medico-legally that they do not focus on actual best practice and putting the best interest of their patient first.

 

The GMC process effectively puts doctors on trial outside of the justice system. When a doctor is exonerated the GMC suffers no penalty. The GMC is not required to make any compensation for the destroyed personal or professional life. They are, in effect, free of liability, so there is no incentive to improve or change.

 

In investigations of serious professional misconduct or other complaints which are not resolved, the parties should be able to approach the Courts of Justice at the expense of the GMC for a fair decision. The GMC is currently not fit for purpose and should not have the sole and arbitrary power to impose conditions, suspension or erasure of a health professional from the medical register.
