From Victims to Villains: The Misjudgment of the Menéndez Brothers
The Issue
"The Menéndez brothers were victims of prolonged, severe sexual, physical, and emotional abuse by their father, which created a psychological state of fear, trauma, and desperation. Modern psychological research confirms that long-term abuse can lead to complex PTSD, impaired judgment, and a heightened fight-or-flight response. At the time of the trial, society and the courts lacked the same depth of understanding we now have regarding trauma responses, especially in cases involving familial abuse. Rather than being treated as victims acting under extreme duress, they were portrayed simply as greedy killers. Today, with the lens of trauma-informed justice and over 30 years of demonstrated good behavior in prison, including efforts to mentor others and stay out of trouble, the brothers represent rehabilitated individuals who deserve reconsideration of their sentences. Life without parole does not reflect a just or proportional outcome in light of these factors.
It’s basically saying: If the case happened now, with what we know about trauma and abuse, the outcome might’ve been very different
