The Issue

Brandon Jenkins has spent more than a decade behind bars while serious constitutional concerns surrounding his conviction continue to come to light.


During Brandon’s post-conviction evidentiary hearing, troubling facts were uncovered that raised major concerns about the integrity of his original trial. The court reviewed testimony, evidence, and investigative actions that called into question whether Brandon received the fair trial guaranteed under the United States Constitution.

 

Most alarming were the concerns surrounding a Brady violation — one of the most serious forms of prosecutorial misconduct in the American justice system. A Brady violation occurs when the State withholds evidence favorable to the defense, including evidence that could challenge witness credibility, support innocence, or affect the outcome of a trial.


The judge’s  Findings of Fact and Conclusions of Law revealed serious credibility issues involving testimony connected to Brandon’s conviction. The evidentiary hearing exposed troubling questions about investigative conduct, evidence handling, and whether critical information was fully disclosed to the defense before trial.


Even more disturbing is that Brandon has maintained for years that he acted in self-defense, yet the withheld evidence and credibility concerns raised during the evidentiary hearing suggest he may never have truly had a fair opportunity to fully present or support that defense before the jury.

 

 

 

 

 

A life sentence.


A punishment that permanently took away his freedom while major questions surrounding fairness, due process, and withheld evidence continue to grow.

 

A person cannot properly defend themselves in court when critical information is allegedly withheld by the State.


These are not harmless mistakes.

These are constitutional issues.

 

The jury that convicted Brandon may never have been given the full truth.

 

For over 10 years, Brandon and his family have suffered the devastating consequences of a conviction now clouded by serious legal and constitutional concerns. While Brandon remained incarcerated, his family lost years of memories, holidays, milestones, and precious time that can never be returned.

 

No justice system should protect convictions at the expense of truth.

 

No person should remain imprisoned when serious concerns exist involving withheld evidence, credibility problems, and violations of due process.

 

This case is no longer just about one man — it is about accountability within the justice system itself. If constitutional protections can be ignored in Brandon Jenkins’ case, then every citizen should be concerned.

 

We are calling on the Texas Court of Criminal Appeals, state officials, civil rights organizations, and all appropriate authorities to fully review Brandon Jenkins’ case and grant justice, relief, and freedom before more years are taken from his life.

 

Justice delayed is justice denied.
