Formal Petition for Urgent and Consistent Enforcement of Bylaws in Paulshof & Surrounds
The Issue
Preamble
The continued failure of responsible authorities to enforce municipal and provincial bylaws is causing a severe decline in the quality of life for the residents of Paulshof and surrounding areas. This negligence has led to a direct negative impact on residents' peaceful enjoyment of their homes and public spaces, an increase in crime, and a consequent decline in property values, threatening our community's status as a preferred residential area.
This petition serves as a formal demand from the undersigned residents and local interested parties for the consistent and thorough enforcement of all applicable bylaws to restore safety, security, and the peaceful habitation of our properties and public spaces.
We hereby detail the primary areas of bylaw infringement and their impact on our community:
1. Illegal Activities Along the Sandspruit and Braamfontein Spruit
Residents are subjected to constant disturbances from groups conducting activities and rituals along the riverbanks. These actions violate multiple bylaws related to noise, public decency, environmental protection, and public safety. Specific infringements include:
- Noise Pollution: Loud day and night-time prayers, persistent drum beating, screaming, and wailing, particularly escalating over weekends.
- Environmental & Health Hazards: Animal slaughter (e.g., chickens) with carcasses left in the river, and significant littering from human waste, plastic containers, cloths, and other ritual paraphernalia.
- Fire Hazards: Ritual fires are lit and frequently left unattended, posing a significant fire risk to nearby homes and the natural vegetation of the spruit.
- Public Indecency: Reports of public nudity during rituals are a common occurrence.
Despite numerous reports to the City of Johannesburg, City Parks, and the JMPD, there has been no effective or lasting intervention.
2. Uncontrolled Growth of Informal Settlements (Squatter Camps)
An informal settlement along the spruit banks is expanding without control, leading to significant social and security issues:
- Increased Crime: Criminal activities, including break-ins and theft in the surrounding residential area, have been directly traced back to the settlement.
- Operation of illegal businesses: Illegal businesses such as precast concrete and the recycling of waste operate from these locations
- Land Use Violations: The illegal occupation of environmentally sensitive public and private land, with no human nor refuse waste removal.
3. Illegal Hawkers and Public Disturbance
Illegal hawkers operate freely along Witkoppen Road and other areas, creating multiple problems:
- Bylaw Transgressions: Trading on a provincial road without permits is illegal.
- Public Nuisance: These sites are hotspots for public drinking and create significant litter, which devalues the appearance of our community.
4. Pervasive Traffic Law Violations by Taxis
Taxi operators consistently disregard traffic laws, endangering residents and other road users daily. These violations occur in full view of traffic officers who fail to act. Common violations include:
- Illegal Parking: Taxis park illegally along Achter Road, Witkoppen Road, and other key thoroughfares, obstructing traffic.
- Reckless Driving: Drivers perform dangerous U-turns over solid lines, ignore red lights, and drive on the wrong side of the road into oncoming traffic.
5. Toxic Fumes and Litter from Informal Recycling
Informal recycling activities along the riverbanks are a source of pollution and health risks:
- Air Pollution: The burning of plastic and other materials to extract metals releases toxic fumes, posing a severe health risk to residents.
- Environmental Damage: The activities result in extensive littering, polluting the river and surrounding green spaces.
Our Demands
We, the undersigned residents, demand that the responsible law enforcement agencies be held accountable. We require immediate and decisive action to put a permanent stop to these infringements. Specifically, we demand:
- Immediate intervention to halt the illegal activities along the spruits, including the enforcement of noise, pollution, public decency, and fire safety bylaws.
- Urgent enforcement of bylaws against the illegal occupation of public land and increased policing to address the crime emanating from the informal settlement.
- Regular enforcement actions to remove illegal hawkers and address the associated public drinking and littering.
- Zero-tolerance enforcement of all traffic laws for taxi operators, to be carried out by the traffic officers already present in the area.
- Investigation and cessation of illegal burning and polluting activities by informal recyclers along the river.
We, the residents of Paulshof, as well as those who work, drive through and enjoy Paulshof facilities, will no longer tolerate the degradation of this community. We demand that authorities fulfil their mandate to restore safety, order, and the peaceful enjoyment of our homes and public spaces.
