This is my contribution to Citizen's Discussion at Tuesday's City Council meeting:
Good morning,
Rocky Mountain Field Institute had been doing $40,000 worth of work each year on the lower section of the Barr Trail since 2013.
Were they in the practice of informing the managers of the Manitou Incline that their crews would be working on the trail on such and such dates each year?
Did the city believe that RMFI workers were volunteers, working for free?
It appears that the city did know that $40,000 in repairs were being done to the land owned by the Cog Railway at the time of the public comment process for the land swap.
It also appears that the city decided to withhold that information from the public.
Is this correct?
We have a different Parks Dept Director, a new Mayor and all new City Council Members so if the information was withheld the blame would not rest on any of you.
It is undeniable that the city presented an incomplete and inaccurate picture of the liabilities on that land.
It appears that the city knowingly withheld financial information in order to make the land appear to be more valuable than it was.
Is this correct?
It is clear that the city now has an obligation to tell the public that some relevant facts were not provided during the public comment process.
Can the city claim that it was an innocent oversight or an accident if it was malicious cheating?
How much spin can the city legally employ?
It is also nearly impossible to believe that Jack Damioli, President of the Cog Railway, did not willfully withhold the information, especially after he heard me asking for the cost of the repairs over and over.
Please provide me with the total cost of all remaining repairs that this land needs.
Please begin the process of public disclosure.
