This is my contribution for Citizen's Discussion at Tuesday's City Council meeting:

Good morning,

At the time of the public comment process for the land swap Rocky Mountain Field Institute was doing $40,000 a year of work on the section of the Barr Trail that the city wanted to acquire from the Cog Railway.

How much has been spent on that trail over the last 6 summers, beginning with 2016 through this summer?

I asked for the total cost of all needed repairs on that land during the public comment process, but the city and the Broadmoor failed to even disclose the fact that $40,000 a year of work was being done each year.

Are the repairs nearly complete?

How many more years will it be necessary to spend $40,000 per year?

That land was appraised at $1,300,000. We now know that this land needed hundreds of thousands of dollars worth of work at the time of the public comment process.

This constitutes relevant financial information.

If the city was not aware of the repairs being done at the time of the public comment process it would be shocking, and constitute negligence, or at least a complete break down of the necessary process of research before asking the public to approve the land swap.

Did the Broadmoor withhold that information from the city?

Mr. Jack Damioli personally gave the public presentations on behalf of the Broadmoor during the public comment process.

He is also the President of the Cog Railway.

Spencer Wren, General Manager of the Cog Railway also spoke during at least one meeting.

Both of them heard me speak, and heard me asking for the total cost of the needed repairs.

If Mr. Damioli, after hearing me speak repeatedly, did not inform the city that RMFI was doing $40,000 a year in repairs on that land, that would constitute fraud or deception.

Why did he not tell me what he knew during one of the meetings we both attended?

How much has been spent on that land since the public comment process in the spring of 2016?

How much more has to be spent before the work can stop?

Has 20% of the appraised value of the land been spent on it in the last five years.

$260,000 would be 20%. Will that amount have been spent by this time next year?

This is like buying a used car for $30,000.

The dealer fails to tell you that the car needs at least $6,000 in repairs, and may need much more than that.

In the world of car sales that is illegal.

How much more in the realm of public comment processes?
