For the Safety of Children: A Petition to Demand Cross-Verification of CPS Records

The Issue

We, the undersigned, are community members and concerned citizens advocating for greater accountability and transparency within Child Protective Services (CPS). We believe that the welfare of our children is paramount and that the processes surrounding their protection must be fair, thorough, and just.

When child protection service (CPS) workers are allowed to create and submit documents without adequate oversight or accountability, it can lead to significant negative impacts on parents and their families. Some of these negative impacts include;

-Misrepresentation of Facts: If caseworkers have the discretion to write documents without verification, there is a risk that personal biases or misunderstandings could lead to inaccuracies. Misrepresented facts can unfairly portray a parent's situation, resulting in incorrect assessments of their fitness to parent.

-Erosion of Trust in the System: Parents may lose faith in the child welfare system if they believe that decisions are made based on unverified or biased reports. This erosion of trust can hinder cooperation between families and CPS.

-Deterred Engagement: Parents who feel unjustly accused or misrepresented may become disengaged and less likely to seek help or intervention that could benefit them and their children.

-Impact on Custody Decisions: Official records created without accountability can lead to decisions that result in the removal of children or limitations on parental rights. These actions can profoundly impact family cohesion and emotional well-being.

-Legal Ramifications: Parents may face legal challenges based on inaccurate or misleading information, adversely affecting their ability to regain custody of their children or even leading to criminal charges.

-Increased Anxiety and Stress: Constant worry about how they are portrayed in CPS documentation can lead to heightened anxiety, stress, and emotional turmoil for parents.

-Feeling of Powerlessness: Parents may feel powerless in a system where they believe they cannot defend themselves against potentially harmful narratives in official documents.

-Access to Support Services: If case summaries inaccurately reflect a parent's circumstances, it could limit their access to services that could assist them. For instance, misunderstandings about a parent’s willingness to participate in services can lead to unjust denials of support.

-Stigmatization: Parents might be stigmatized based on inaccurate reports, impacting their personal and professional relationships, and causing long-term social repercussions.

-Negative Outcomes for Children: If parents are inaccurately assessed as unfit, children may be unnecessarily removed from their homes, leading to instability and disruption in their lives. This can have lifelong consequences on their emotional and psychological development.

-Family Separation: Unchecked documentation can lead to wrongful family separations, which can be traumatic for both children and parents.

-Disproportionate Impact on Vulnerable Families: Families who are already marginalized or facing socioeconomic challenges may be disproportionately affected by inaccurate documentation, exacerbating existing inequalities within the child welfare system.

Recent incidents have highlighted troubling practices regarding the handling of records and the accuracy of information used by CPS workers in decision-making processes. In light of these concerns, we are calling for the implementation of robust cross-verification procedures for CPS records to ensure accuracy, reliability, and accountability. It’s crucial to implement a system that ensures transparency, accountability, and accuracy in the documentation processes used by child protection social workers. Here are some proposals that could help establish such a system:

Implementation of Review and Cross-Verification Procedures:

-Establish a systematic process to cross-verify information used by CPS workers in assessments, investigations, and interventions with other reliable sources, including law enforcement, medical records, and educational institutions.

-Establish a protocol where case summaries and official documents created by social workers must be reviewed by a supervisor or a designated independent party before being submitted to experts. This could help ensure accuracy and allow for corrections as needed.

-Create a peer review system where case summaries are evaluated by another social worker or a team before submission. This review should focus on factual accuracy, clarity, and adherence to ethical standards.

-Form an independent oversight body responsible for monitoring the documentation practices of child protection services (CPS). This body can conduct audits of case files and random spot-checks to ensure compliance with accuracy and ethical standards.

Training and Standardization:

-Require mandatory training for all CPS staff on accurate record-keeping, ethical practices, and the importance of verification to mitigate misinformation.

-Regularly implement training programs for social workers on documentation best practices, including how to write accurate, objective, and clear case summaries. Ensure that they understand the significance of accurate documentation in the well-being of children and families.

-Conduct regular independent audits of CPS case records to ensure that all information is accurate and that the procedures in place are being followed.

Increase Transparency in Operations:

-Create processes that allow for increased transparency in CPS operations, including access to records by parents and guardians involved in cases to ensure they are aware of the information being used against them.

-Require CPS to publish aggregate data and statistics relating to the accuracy of documentation, findings from oversight audits, and outcomes of cases. Increased transparency can create public accountability.

-Allow parents to review relevant portions of their case summaries and provide feedback or corrections before the documents are submitted to experts. This can help enhance transparency and ensure that the perspective of the parent is included.

Utilize Technology Solutions:

-Leverage technology to create a secure system for documenting and tracking case summaries. This system can include timestamps, version control, and audit trails that track any changes made to documents, ensuring accountability.

-Develop a standardized template that outlines specific information required in case summaries. This template should include sections that require evidence or documentation to support claims made in the report. It can help maintain consistency and reduce the potential for bias.

Accountability for Misinformation:

-Mandate that any claims or statements made in case summaries be supported by specific evidence or factual references, such as logs of communication, previous reports, or assessments. This requirement can reduce the scope for unfounded allegations.

-Establish clear consequences for CPS workers who knowingly fail to follow verification procedures, to discourage misconduct and protect the integrity of the system.

-Implement regulations that allow for penalties or disciplinary actions against case workers found to be providing knowingly false or misleading information in case documents.

Lack of accountability for CPS documentation practices creates numerous risks for parents and their families. By allowing unchecked and unverified documentation to become the basis for official records, the system undermines parental rights, perpetuates injustice, and ultimately impacts the well-being of children involved.

Advocating for accountability and transparency is essential to ensure that the child welfare system operates fairly and justly. We believe that implementing these measures will enhance trust between families and CPS, ensuring that decisions made in the name of child welfare are based on accurate and verified information.

Addressing the lack of accountability within the Child Protection Services Division at the soonest possible time is crucial for several reasons:

Accountability is needed to ensure trust in almost every organization or system, without it, those involved believe have no boundaries, and anything without boundaries eventually ends up in chaos. Symptoms of chaos include apathy, broken promises, going through the motions, disengaged staff members, frustrated staff members, resentful staff members, and general lack of care.

Lack of accountability has been ignored for reasons such as "that's how it's always been" or "it's just the way it is", and this has lead to repeated mistakes, each compounding the previous ones and causing further harm. If the absence of accountability within the child welfare system is not addressed promptly then you as the lawmakers and leaders of our country are allowing behaviors that are not aligned with that of the agency tasked with protecting children and supporting families in crisis, which absolutley HAS and WILL continue to impact those around us, probably more than we realize.

If you are going to assign such important work that has an impact on your community, make sure you’re comfortable with that impact and on being questioned about it. If you’re not, then you need to do more work to get there.

There has to be accountability for a culture to thrive. If people aren’t held to account for poor behaviors or doing things that are against the values of the agency there is little point in trying to change or improve the culture.

Ensuring that accountability is baked into the culture of the Child Protective Services Agency is crucial. Making sure accountability is part of performance reviews and appraisals is crucial. If it isn’t, it’s not really going to be ‘how things are done around here’ and the accountability isn’t going to stick.

By signing this petition, we lend our voices to the call for systematic reform within CPS to ensure that our children are protected while safeguarding the rights of families.

We urge you to take our concerns seriously and to act promptly to implement these essential changes. The well-being of our children and families depends on a trustworthy and accountable system.
