Florida Agents Deserve Timely Pay: End Commission & Draw Delays

The Issue

If you’re a Florida real estate agent who has ever waited months for your commission or draw—this is your moment to be the change.

➡️ In-house agents are promised monthly draw payments—

Imagine dedicating yourself full-time to a new development project. You stop taking outside deals because you’re promised a monthly draw and future commission payments. You work long hours — hosting events, touring clients, following up leads — fully committed to selling the project.

Then the payments don’t come.

You’re told “the developer hasn’t paid yet” or “it’s delayed another few weeks.” One month passes. Then two. Meanwhile, the bills don’t wait. Your rent is due. Your car payment is due. Groceries, insurance, utilities — they all pile up.

Many agents live on the promise of those draws to bridge the gap between contracts and closings. Without them, they’re forced to max out credit cards, drain savings, borrow money from family, or even take on side jobs — all while still showing up every day to push millions of dollars in inventory for developers who are holding back their pay.

This is not just inconvenient — it’s financially devastating. An agent could lose their apartment, wreck their credit, or step away from the industry entirely because they couldn’t survive the months-long wait for money they rightfully earned.

➡️ Outside agents face the same struggle, often waiting months after closings to receive commissions. These delays discourage agents from bringing buyers to new construction projects, ultimately hurting developers, brokerages, and Florida’s real estate market as a whole.

 

           We call on FREC and DBPR to implement urgent reforms:

 

  • 30-Day Payment Rule – Require brokerages to pay draws and commissions within 30 days, regardless of developer delays.
  • Escrow/Trust Accounts – Ensure commission funds are secured in escrow at the time of contract.
  • Transparency & Accountability – Mandate clear communication and penalties for non-compliance with payment timelines.
     

We also call on the National Association of Realtors (NAR) to recognize these systemic issues and support Florida agents in demanding fair, timely compensation. As the largest professional organization in real estate, NAR’s advocacy and influence are critical in ensuring that our industry upholds standards of fairness and accountability.
