Federalize daily overtime laws for fair compensation

The Issue

As one of the 80 million hourly workers in the USA, I’ve experienced the outdated rule in the Fair Labor Standards Act (FLSA) of 1938 that excludes vacation or holiday hours from the 40-hour overtime threshold. This allows companies to avoid paying overtime, making it harder for workers to keep up with rising living costs. For example: If a worker logs 4 extra hours on Monday but takes a paid day off on Friday, the week totals 44 hours—but only 36 count toward overtime. The 8 hours of paid time off don’t qualify, so all hours are paid at straight time. Millions face this issue, missing out on fair overtime pay. The fix: Federal law should adopt a daily overtime standard like California’s Labor Code, paying premium rates for hours beyond the regular daily schedule. This would ensure fair pay for extra work and value employees’ time. According to the U.S. Bureau of Labor Statistics, in 2024 about 50% of full-time wage and salary workers (over 60 million people) were paid hourly.   With increasing costs, fair overtime adds to financial stability, and it could enhance productivity by rewarding effort.
