As of July 24, FAU PD is a participating agency in the U.S Immigration and Customs Enforcement 287(g) program.  This authorizes FAU PD to exercise immigration enforcement during routine police enforcement duty, including "the power and authority to arrest without a warrant." This denies any student suspected of being an alien the right to due process, exposing them to police violence and unlawful abduction.

Innocent, lawful students at Florida universities (including US citizens) have been harassed, detained, abducted and deported by local law enforcement officials with 287(g) authority. These include young Americans like Maria Martinez, Felipe Zapata Velásquez, and Juan Carlos Lopez-Gomez.

ICE operates with zero accountability and frequently violates due process.  Hundreds of U.S. citizens have been detained in inhumane detention facilities based solely on racial profiling. ICE agents have been directed to detain anyone they believe is undocumented, regardless of actual legal or arrest warrant status. Victims of this process are imprisoned in detention facilities like Alligator Alcatraz, where they are denied access to legal representation and often die in captivity.

This is vile and evil. It's also unconstitutional and illegal. Meanwhile, Florida Atlantic University has quietly entered a 287(g) agreement with ICE, endangering over 31,000 students across its six campuses. FAU PD is not compelled by local, state or federal law to enter this agreement. It did so voluntarily.

Fortunately, it is just as easy for FAU PD to pull out: the contract they signed with ICE allows them to terminate the 287(g) agreement at will.

This petition represents the will of FAU students, faculty, alumni, donors and all Americans with respect for our Constitution, the rule of law, and human dignity. FAU must terminate the 287(g) agreement to keep ALL students safe.
