Fair new trial for Edgar Garcia

The Issue

I am petitioning for new and fair capital jury trial for Edgar B. Garcia. Listed below you'll find some of the most troubling discrepancies out of the many in his case.

Everyone is aware of the long and shameful history of discrimination against minorities which exists within the U.S. courts because such things are systemic, in many ways, the influences are not openly obvious. This was not the case with the trial of Edgar B. Garcia.

Edgar spent the first ten years of his life in Mexico, but the attorneys who represented him at trial did not even hire a translator to communicate with his family or bother to obtain any record from that period to properly prepare a defense.

In addition to this, it has since been determined that the jury venire-selection process was not drawn randomly, therefore, violating the jury selection and service act and Edgar's sixth amendment right to have a jury drawn from a fair cross section. The evidence suggest that a "special" illegal master wheel was drawn for his trial, which means the entire process, the core element of our right to both due process and fair trial, was violated by those who represent "We The People" on a capital level. Considering the fact that Edgar was discriminated against by both the prosecution and his own defense attorneys, can it come as any surprise that his trial ended in conviction and the ultimate penalty?

Out of 10 men who are currently sentenced to death for a federal prison incident, 7 are from the same Eastern District of Texas, including Edgar. All 7 incidents happened in the same federal prison, the U.S. Penitentiary in Beaumont. All 7 were tried in the same court house. All 7 used some of the same defense attorneys. Most had the same prosecutor and judge. In the history of the B.O.P. (federal Bureau of Prisons), there are 287 documented incidents resulting in death. 84 of them, or 30%, are currently serving life, and 167 actually have release dates. Edgar is in the 3.6% who received a death sentence. Why is the Eastern District of Texas not being red flagged when it is the only area in this country accumulating such a high rate of death sentences, 70%, when there are around 200 federal institutions with 200,000 prisoners across this country.

Edgar has been in federal custody for half of his life. Since 2007, he has not received any disciplinary infractions and has utilized his time to exhaust any educational and recreational programs available. He's also received his GED and is a self-taught artist. His creativity expands to other forms of expression. Despite having been in isolation for a major part of his incarceration, Edgar has managed to find ways to grow in positive ways and contribute to society. He even has a play written about him "Edgar and Me." He is the epitome of rehabilitation and redemption, but also what is wrong with our justice system.
