The good news is that, without direction from the congressional Select Committee, the FAA on their own began work to fix the noise problems of SERFR. By adjusting the path so that it does not conflict with air space boundaries, planes should begin to fly quieter for residents under SERFR in Santa Cruz County and parts of Santa Clara County by February 2018. While this does not resolve the problem of low altitudes for communities closer to the airport, it does defeat the argument that the path must shift to BSR (BIGSUR) in order to resolve noise.
The bad news is that, during a December 2 meeting hosted by Rep. Jimmy Panetta, Supervisor John Leopold, Quiet Skies NorCal, and Save Our Skies Santa Cruz, Leopold announced that the path shift from SERFR to BSR could occur anyway and as soon as August 2018 with little or no input from stakeholder communities. This is problematic for many reasons, including:
• FAA testimony confirms that they are unable to meet the required criteria for a path shift.
• From a legal perspective, the FAA cannot disregard their own rules for environmental review.
• SERFR 3’s February 2018 implementation should resolve noise and therefore, consideration of a new NextGen BSR flight path should be halted until SERFR 3 can be analyzed.
• Rep. Anna Eshoo promised transparency, comprehensive environmental review, regional consensus, and no shifting noise.
• Stakeholders have not been engaged. Stakeholders oppose BSR. No regional consensus.
