Expedite trial and justice delivery in rape cases for swift justice to rape victims

The Issue

On behalf of concerned citizens of India, I am submitting this petition to request urgent action to expedite the trial process for rape cases against women. Despite legislative reforms and fast-track courts, victims of sexual assault in India still cotinued facing significant delays in their quest for justice, prolonging their trauma and creating a culture of impunity for perpetrators.

Current status and facts:

  • Case backlogs: According to the National Crime Records Bureau (NCRB) data, there were over 1,66,882 pending rape cases in Indian courts in 2022. Despite efforts, the judicial process remains slow, leading to severe backlog and delays in delivering justice.
  • Low conviction rates: The conviction rate in rape cases has hovered around 27.6% as per recent NCRB reports. This low rate discourages survivors from pursuing legal action, knowing that justice is far from certain or quick.
  • Delayed justice impacts society: Delays in these cases not only exacerbate the trauma for survivors but also send a message of inaction, reducing the public's trust in the judicial system. A faster resolution of such cases could serve as a deterrent to potential offenders and restore faith in the justice system.

Proposed solutions and immediate actions needed:

  • More fast-track courts for rape cases: Setting up more fast-track courts dedicated solely to cases of sexual assault and gender-based violence could ensure quicker hearings, trials, and judgments. These courts should aim to resolve cases within a period of six months.
  • Digital case management: Leveraging technology through digital case management systems can streamline the judicial process, enabling better tracking and coordination to reduce unnecessary delays in case scheduling and management.
  • Mandatory legal aid and psychological support: Survivors should receive comprehensive legal aid and psychological support throughout the trial process. This would not only assist them in coping with the trauma but also empower them to face the proceedings confidently.
  • Regular monitoring and accountability: An independent monitoring body could be established to ensure rape cases in fast-track courts are resolved within the stipulated time and to provide regular status updates to victims.

Expediting justice in rape cases is not just a legal necessity but a moral one.

By prioritizing and fast-tracking such cases, the government would take a significant step in protecting women, upholding human rights, and reinforcing the importance of justice in Indian society. Such an example would instill confidence in the judicial system and discourage future incidents.
