Their earnings from VA disability are unjustly considered income for child support, forcing them into tough economic conditions. Disability payments are compensation for injuries suffered serving the country and should not be treated as regular income.
This issue causes a ripple effect; retired service members are discouraged from applying for VA disability benefits they rightfully deserve, fearing that these payments will be taken away for child support. This needs to change.
Statistics shed light on the problems veterans face. According to the National Veterans Foundation, about 2.7 million veterans receive disability compensation, and many of these veterans are likely facing similar child support issues. It is time we stand up for their rights and unique circumstances they're put in after their selfless service.
We call on lawmakers to enact legislation preventing courts from counting VA disability payments as income for child support calculations.
