Nationwide Child Access Prevention
The Issue
The change being proposed is a baseline nationwide child access prevention law (CAP law) that holds the legal gun owner criminally liable for allowing a minor to use a firearm that results in injury or death.
Many states have their own CAP law that range from "negligent storage" to "directly providing" and this proposal is somewhere in the middle. A more detailed explanation of each states laws can be found in the provided reference, as well as statistics involving minors and gun access. Many minors live in households with legally obtained firearms. Regardless of what type of firearm, children should not be able to access someone else's firearm without their knowledge, and approval. If an adult chooses to allow their child access to a firearm, and their state does not have a more strict law prohibiting this, that is the adults choice to do so. However, the gun owner should be held accountable for any injury or death that is a result of their firearm.
While this would be a new gun law, it does not limit anyone who can currently own a gun from doing so, nor does it prohibit any type of firearm. Legal, responsible gun owners should already hold themselves accountable for their firearms, it is now time to make them legally accountable as well.
