Equal Standards in Immigration Review: A Call for Transparency in Melania Trump's Case.

The Issue

The Trump administration created policies allowing immigration authorities to retroactively review the files of naturalized U.S. citizens to look for inconsistencies. If these standards apply to ordinary people, they should apply to EVERYONE

Public reporting as raised unresolved questions about Melania Trump's early immigration history. To ensure fairness and transparency, we request a review of the publicly reported concerns:

1) Tourist Visa and Early Modelling Work

  • Melania Trump reportedly entered the US in the mid 1990s on a tourist visa (B-1/B-2)
  • Tourist visas do not allow paid work
  • Multiple reputable sources reported that she performed paid modelling work during this period
  • If true, this would be in violation of visa terms.
  • Her lawyer stated she followed all laws, but her immigration file has never been released to confirm the timelines.
  • There has never been an official review leaving the controversy unresolved.

2) EB-1 "Einstein Visa" Concerns

  • In 2001, Melania Trump received an EB-1 visa,  typically reserved for individuals with "extraordinary ability."
  • This category is usually granted to Nobel Prize winners, Olympic athletes, leading academics, or internationally recognized figures.
  • Immigration expert interviewed by major new outlets described her EB-1 approval as highly unusual.
  • Without transparency, the public cannot understand how this extraordinary-ability standard was applied.
  • Melania Trump has also publicly claimed to have completed a university degree that the institution says she did not finish
  • This discrepancy raises additional questions about the credentials presented during her immigration process and further underscores the need for transparency.

3) Participation in the "Birther" Conspiracy

  • Melania Trump publicly questioned President Barack Obama's birth certificate in multiple interviews
  • She advocated for verifying another person's documentation.
  • If she supported documentation scrutiny for others, it is reasonable to expect equal scrutiny of her own immigration history.

4) Double Standard in Immigration Enforcement

  • Under Trump-era policies, many lawful immigrants and naturalized citizens were subjected to retroactive investigations.
  • Some faced denaturalization proceedings for minor inconsistencies.
  • High profile individuals should not be exempt from the standards applied to ordinary immigrants.
  • Transparency builds public trust and ensures equal treatment under the law.

What This Petition Requests

This petition does not assume wrongdoing. It simply calls for:

  • A review of the publicly reported concerns
  • Clarification of the EB-1 extraordinary ability qualification
  • Equal application of immigration review standards
  • Transparency in high profile cases to maintain public trust
