Ensure Justice for Those Wrongfully Convicted
Everyone deserves a fair trial and a justice system that carefully considers all relevant evidence before someone's liberty is taken away.
This petition calls for stronger safeguards and independent review mechanisms for people who believe they have been wrongfully convicted, including in cases involving serious sexual offences.
Sexual offences must be taken extremely seriously, and genuine victims deserve to be listened to, supported and protected. At the same time, the justice system has a responsibility to ensure that every allegation is investigated thoroughly, that evidence is properly scrutinised, and that defendants receive a fair and impartial process.
Where there are concerns about the reliability or consistency of evidence, or circumstances that may warrant further investigation, there should be an effective and independent mechanism for those concerns to be examined.
We therefore call for:
Thorough and impartial investigations into all relevant evidence and circumstances surrounding serious allegations, without assumptions being made about either the complainant or the accused.
Independent review mechanisms for cases where there are credible concerns that a conviction may be unsafe or that significant evidence was not properly considered.
Greater scrutiny of evidence where there are significant inconsistencies, credibility concerns or other circumstances that could materially affect the reliability of a case.
Appropriate consequences for deliberate false allegations where, following a proper investigation and due process, it is established that an allegation was knowingly fabricated.
Better safeguards for defendants and victims alike, ensuring that protecting genuine victims and preventing wrongful convictions are treated as complementary aims rather than competing priorities.
A wrongful conviction can have devastating and lifelong consequences for the individual involved, their family and the wider community. Equally, failing to properly investigate genuine offences can cause profound harm to victims.
Our justice system should be capable of protecting both principles.
This petition is not about dismissing genuine victims or undermining the seriousness of sexual offences. It is about ensuring that convictions are reached through a fair, thorough and evidence-based process, and that there is a meaningful route to independent review when credible concerns about the safety of a conviction arise.
We are calling for reform that strengthens public confidence in the justice system, protects the rights of everyone involved, and helps prevent future miscarriages of justice.
