The Issue
ICE’s enforcement practices in Minnesota reflect a disturbing pattern of unconstitutional conduct that threatens the civil rights of U.S. citizens, lawful residents and immigrant families alike.
Rather than focusing on individuals with serious criminal records, ICE has increasingly relied on warrantless detentions, racial profiling, and intimidation—actions that destabilize communities and undermine trust in government.
No federal agency is above the Constitution.
How Are Our Constitutional Rights Being Violated?
First Amendment – Free Speech and Assembly
• Intimidation and retaliation against activists, journalists, and community members who lawfully protest or speak out
Fourth Amendment – Unreasonable Searches and Seizures
• Detentions and arrests without judicial warrants
• Stops and seizures based on suspicion rather than probable cause
Fifth & Fourteenth Amendments – Due Process and Equal Protection
• Detention without timely access to legal counsel or a fair hearing
• Racial profiling and discriminatory targeting
• Expedited removals that bypass meaningful due process

ICE enforcement tactics that focus on children as a means to locate undocumented parents are inflicting profound and lasting harm.
• Schools—meant to be safe havens—are becoming places of fear
• Children experience anxiety, trauma, and disrupted learning
• Parents are afraid to send their children to school or engage with educators
• U.S. citizen children are effectively punished for their parents’ status
Children are not enforcement tools. Using fear of family separation to pressure parents violates basic principles of due process, equal protection, and human dignity.
