BACKGROUND:
On March 21, 2025, a federal civil rights lawsuit was filed in the U.S. District Court for the District of Arizona:
- Ramirez v. Whitt et al., Case No. 2:25-cv-00941-SPL.
The plaintiff, Mario Ramirez, a former officer with the Phoenix Veterans Affairs Police Department, brings claims of retaliation by department leadership after he raised concerns about internal misconduct and filed an EEO complaint and multiple Whistleblower complaints the VA Office of Accountability and Whistleblower Protection (OAWP).
The complaint includes the following allegations:
- An improper and unauthorized administrative investigation was initiated.
- Ramirez was allegedly denied legal representation, which the lawsuit asserts
- violates his rights under the 5th and 6th Amendments of the U.S. Constitution.
- The conduct further violated internal policies outlined in the Department of Veterans Affairs Handbook.
- The lawsuit also brings claims under 42 U.S.C. § 1983, citing the deprivation of constitutional rights under color of federal authority.
The case is pending before the U.S. District Court.
