End Charitable Immunity for Sham Charities
End Charitable Immunity for Sham Charities
The Issue
Any cultural institution is protected by a “charitable immunity” legal clause in tort cases. This protects museums from slip n’ fallers, that sort of thing. Charitable Immunity stipulates that a charity may never have to pay out more than $20,000.00 to whomever they have harmed through bodily injury, slandered, victimized through malice, stolen from, interfered with or harmed through dereliction of duty to their own codes of conduct, by laws or physical access, to name a few.
This has made charities the potential favorite breeding ground of the neo-colonial, money launderers who can do all sorts of harm to the charity, itself, as well as to those who founded the cultural institution, that has been captured by bad actors. But hey a little renovation and face lift ties it all up with a nice neat little bow. Anyone looking to sue for damages may subsequently be blocked by the convenient “charitable immunity” clause, ironically installed to protect the charity.
