Final pre-meeting update with a few last-minute notes.
- The P&Z meeting is still scheduled for *tonight* (November 21, 2024) at 6:00pm.
- Location: Town Hall of Edgewood Commission Chambers, 171-A State Rd. 344, Edgewood, NM 87015 (Google Maps Link).
- Regarding public comments, Edgewood announced (via their Facebook);
- "Rules of evidence must be followed. All legally-affected parties will have the opportunity to present evidence as their testimony. Legally-affected parties are the applicant and adjacent property owners.
As a courtesy to the community, 45 minutes of public comment from other parties will be heard. A limit of 1 minute per speaker will apply." - As a result, please do your best to focus on the harm and verifiable evidence (regulatory/process violations, incorrect data points, etc...) to make your statement as relevant and applicable as possible. This is of utmost importance.

- You may still hand-deliver a letter tonight, if you have not already.
- You should anticipate a full-house, and plan travel accordingly.

Some key data points to keep in mind:
- Currently, 1630 people have signed this petition. We are on pace to exceed 1700 by the time of the meeting. This petition has been active for 9 days at this point.
- Please review the latest announcement from EMPAC, which includes the letter delivered to Edgewood.
- Please review the summary and letter provided TO Edgewood P&Z BY their own attorney/counsel. This highlights some significantly risky specifics of the approach being considered tonight, from a legal standpoint.
- "In sum, I'm NOT optimistic that Campbell can rely on the 1999 Ordinance."
- As outlined in the above letter and discussed elsewhere, there is no legal precedent for using previous Ordinance/code unless there is vested rights have been established via;
- Application approvaed by a regulatory body (Edgewood P&Z)
- AND they (CR) have taken some action in reliance on that approval (eg. projects in progress)
- "I did not see anything in those provisions or annotations suggesting that approval of a master plan should permit a developer to proceed under the zoning regulations existing at the time of approval."
- NM supreme court has established, via precedent, that master plans are "flexible and advisory", ... "the master plan, being only a resolution, does not bind the City to any specific procedures as would an ordinance.".
- Thus, at time of first approval, Subdivision Ord 1999-R would be binding while the Master Plan (both then and now, revised) are not. Latest Subdvision Ordinance (2019-04) should, by law, take priority.
- Multiple data points cited in the CRMP are arguable - at best incorrect and at worst intentionally misleading. See previous update here , specifically sections near the end with references around annual precipitation, basin status, wildlife evaluation & conservancy, and re-plat/sub-dividing requirements.
- Bernalillo County has denied, with cause, this proposal in the past.
- BernCO Commission recently stated CR "poses a severe and unacceptable threat to the health, safety, and welfare of the East Mountains...", in an opposition letter from Nov 2024.
- No sufficient plan has been communicated around necessary public infrastructure (fire, police, education, traffic, ...) or basic living requirements (utilities to include water) and there is no enforce-ability by Edgewood or other parties to ensure any of these "sub-developers" proceed with these considerations in mind.

Regardless of outcome this evening, know that this conversation is not over and will be fought as long as necessary.
