Officer Liability: Section 20 of the Act states that any government officer who permits or neglects to stop violations is deemed to have committed misconduct and is subject to disciplinary action.

Section 20 of the East Kolkata Wetlands (Conservation and Management) Act, 2006 It stipulates that if any officer permits, neglects, or willfully fails to act, allowing an offense or

 offenses committed by officers of the State Government or local bodies. under this Act to occur, they are deemed to have committed misconduct in their official duties, subjecting them to disciplinary proceedings and penalties. 

 

Key Aspects of Section 20 & Related Enforcement:

Officer Accountability: Any government official neglecting duties that lead to EKW violations is liable for penalties, overriding other service laws.

 

Enforcement Action: 

In addition to this, the East Kolkata Wetlands Management Authority (EKWMA) has filed over 200 FIRs against violations in the wetland area, and this section highlights the liability of officials involved.

Context: 

The 2006 Act (and subsequent 2017 amendment) was created to protect the 12,500-hectare Ramsar site from illegal conversion and encroachment. 

This section ensures that the East Kolkata Wetlands Management Authority (EKWMA) and relevant departments strictly enforce the law, preventing illegal land use, such as filling in water bodies for development.

Rule 5 is very important 👇🏻Nothing in this section shall empower the authority to grant sanction for change of character or mode of use of a land unless the change is for improvement or upkeep of local environment and it's surrounding.
