Drop SC Law Mandating 10% Bond with No Payment Plans

The Issue

Having loved ones in jail is a painful experience. Not for their absence alone, but also because of the financial burden weighing down on their families. In South Carolina, this struggle is exacerbated by a law that mandates a minimum of 10% payment of the total bail amount in cash, with no options for payment plans. Many families, like mine, cannot afford to post bail, leaving our loved ones languishing in jail while awaiting trial, sometimes for months. This not only disrupts families but also has severe social and economic impacts on the community.

The existing law disproportionately affects low-income families, who are already striving to make ends meet. According to the Prison Policy Initiative, individuals in jail nationwide earn an average annual income of less than $20,000 prior to their incarceration. Few can afford the exorbitant upfront payment, which results in many being detained simply due to their financial situation. This perpetuates the cycle of poverty and affects the community’s overall well-being.

Furthermore, this approach takes a heavy toll on taxpayers. The low-level offenders who cannot pay their bond clog up the system, leading to overcrowded jails and increased operational costs. According to the Vera Institute of Justice, it costs the government an average of $31,286 per inmate annually. Implementing a more flexible payment system could alleviate these costs significantly.

A more equitable solution would be to allow payment plans for bail. This change could ensure that individuals still have access to due process while awaiting trial without enduring unnecessary incarceration due to financial limitations. It would help families reunite faster, reduce incarceration rates, and save taxpayers money.

We call upon South Carolina legislators to amend the unjust statute, allowing payment plans to be an option for bonding. Adjusting this law is a critical step towards a more just system that treats individuals equally regardless of their financial standing.
