My husband and I were excited to open a legitimate business, having secured a signed lease agreement to rent a commercial shop. However, our dreams were shattered when the owner, misinformed about us allegedly living in the shop, pressed charges that led to my husband's unlawful arrest for trespassing. Though the trespassing charge was dropped, a faulty judicial process, flawed by a fixed jury, unfairly convicted him of resisting arrest. He now faces a year in jail due to this injustice.

Our story is unfortunately not unique. Across the country, individuals are being prosecuted for resisting arrest even when the initial arrest was illegal and unfounded. This not only undermines the justice system but unjustly punishes those who should not have been arrested in the first place. It is crucial to acknowledge that a resisting arrest charge should not stand in situations where the original arrest is deemed illegal. Especially in cases where charges leading to an arrest have been dropped, or where individuals were merely defending themselves against harm during such arrests.

The current laws fail to protect citizens from these legal discrepancies, creating a system where people can be unjustly incarcerated. According to the Bureau of Justice Statistics, tens of thousands of arrests are overturned annually due to wrongful intent or erroneous enforcement, yet the stain of resisting arrest persists on the individuals' records. This highlights the urgent need for reform.

We call upon legislators and the justice system to re-evaluate and amend the resisting arrest laws. Resisting arrest should not be a standalone charge if the preceding arrest was inherently illegal. Moreover, these laws must be revised to include protections for individuals defending themselves against injury during such arrests.

By changing these laws, we not only ensure justice is served but also restore public trust in our legal system. It will prevent further harm and wrongful imprisonment of innocent citizens and respect their rights to fair and equitable treatment.
