We have been very disappointed and concerned by the Ford Government's lack of appropriate action regarding Ontario builders selling newly built homes with used/damaged furnaces.

Minister Thompson and her ministry have known about this serious issue for a long time. CPBH has written to Minister Thompson numerous times about this issue over the years.

The media has reported on this matter, e.g., 2016 article in an industry publication  http://plumbingandhvac.ca/damaged-during-construction/ and the CBC's reporting in 2019:  https://www.cbc.ca/news/canada/ottawa/furnace-construction-1.5188006

CPBH has also written to Tarion and the new spin-off regulator (HRCA). about these issues. But this practice continues, across Ontario.

Selling newly built homes with used furnaces without informing the buyer contravenes the Consumer Protection Act. A legal opinion obtained by CPBH confirms this. http://canadiansforproperlybuilthomes.com/wp-content/uploads/2021/03/Feb.-28-2021-Moher-Legal-Letter-of-Opinion-re-Consumer-Protection-Act.pdf

Surely the Ford Government, Tarion and HCRA cannot support builders breaking the law.  There are many related questions. Here is a start:

Why did Minister Thompson not act swiftly to protect consumers and stop builders from breaking the law in this way? She is the Minister responsible for consumer protection in Ontario after all.

The CEOs of Tarion and HCRA are both lawyers.  Why did they not act swiftly to protect consumers?  They are supposed to be "consumer protection" organizations.  As well, the Ministry of Government and Consumer Services (Minister Thompson's ministry) gets paid to oversee Tarion and HCRA.

How will the Ford Government rectify this problem for the countless Ontario families who have used/damaged furnaces in their newly built homes?

How will the Ford Government stop this practice among builders?
