This is a significant development - and perhaps the first time that this has happened in Ontario.

David Roberts, a former senior official with Tarion, and a former police officer, has filed a Breach of Trust complaint with the Ombudsman of Ontario against Minister Lisa Thompson, the Minister who is supposed to oversee Tarion.  Key issues included in his complaint are allegations that Minister Thompson:

- failed to call for a full criminal investigation regarding the possibility that consumers were defrauded through collusion;

- failed to disclose reasons for maintaining Tarion's monopoly;

- has not ensured that the new Tarion "spin off" - the Home Construction Regulatory Authority (HCRA) - and Tarion have separate responsibilities; and

- has allowed perceived conflict of interest in board appointments.

Mr. Roberts now awaits word from the Ombudsman of Ontario regarding whether the Ombudsman of Ontario will investigate this complaint.
