Don't Weaponize Native American History Against Immigrants
The Issue
The Trump administration is citing an 1884 Supreme Court ruling that denied citizenship to a Native American man to justify ending birthright citizenship for children of undocumented immigrants. The Supreme Court hears oral arguments Wednesday.
The ruling, Elk v. Wilkins, has nothing to do with immigrants. Experts on Native American law — including the National Congress of American Indians — say it rests on the unique legal status of tribal nations and cannot be applied to immigration. The Supreme Court said as much in 1898, ruling in United States v. Wong Kim Ark that children of immigrants born on U.S. soil are citizens.
The 14th Amendment is clear: everyone born in the United States is an American. Using a ruling that harmed Native Americans as a weapon against immigrant children is not legal precedent — it is a pattern of exclusion.
