The Issue

We were Domino's Pizza employees at store #6538 in Los Lunas, New Mexico, 87031, part of Team New Mexico. We are writing this petition because we have been sexually harassed at our place of work and Domino's has decided to not only do nothing about it but punish us, the victims, instead of the individual doing the harassing.

 We had reported the harassment since December 2014 to our store manager and our supervisor. The harassment began with sexist comments on behalf of a male assistant manager who did the hiring. His comments were about the female applicants. He bragged openly on several occasions about hiring females only after checking how "hot" they were on their social media profiles. For the positions of customer service reps/insiders he exclusively hired women only. Nalleli Reyes reported these incidents to the supervisor who, to her surprise, expressed she was already aware of the behavior of this assistant manager and the comments he was making but assured her that she had already talked to him about it. Toni Chacon was one of the female employees hired by this individual and she too made a sexual harassment complain after he had made sexually explicit comments to her about rape fantasies and after he physically touched her. Our supervisor wrote her up for participating in the behavior. That was the only action taken, to punish and humiliate the victim rather than punishing the individual doing the harassing. Because the store was still hiring, one of our assistants at the time, Natasha Nunez, asked this individual if he would consider hiring her cousin because she had full availability. Unfortunately, he was only concerned about how "hot" she was. Again, our supervisor was notified of these comments and she, again, did nothing. In March 2015, Leslie Ramirez was hired by this individual. She was very excited about working at Domino's because it was her first job. But right away the harassment started. She was told by this individual she needed to call him after work. He added her on social media and began messaging her. Leslie was made to feel very uncomfortable. On one occasion Nalleli Reyes observed this individual putting his arm around Leslie Ramirez and she notified the general manager at the time but nothing was done. By June 2015 there was a new manager in the store. We expressed how uncomfortable we were working with this individual and the new manager gave us his word that he was going to change things.

 Little did we know that by making changes he meant he was going to get rid of all of us. He began by cutting our hours dramatically. We went from a minimum of 25 hours to 2 hours a week. The first one to get fired was Leslie Ramirez. The manager had accused her of leaving a large bill in the register but the problem was that she was not in charge of the register. He yelled at her in front of the crew and made her cry. She was taken off the schedule and was not even told she was fired until she came to pick up a paycheck. Next was Natasha. She was told she was being terminated because she talked about the harassment and because she wasn't going to fit in at that store anymore. They had already hired a male employee to replace her. Nalleli was the third person to be retaliated against. She was forced to transfer stores or be fired. She was also told by the manager that Domino's didn't want anyone to be talking about or reporting sexual harassment and that he should have fired everyone the moment it was brought up to him. She explained to him that she had seen it and heard it but his response was that if he didn't see it then it didn't happen. Toni was the last person to go. She was scheduled for two hours of work and was sent on a break after only one hour. The assistant manager interrupted her break to tell her she was tired of her attitude and was sending her home. The next time she worked she was written up for this alleged attitude problem, when she refused to sign the write up because the accusation was not true she was fired.

 All of us enjoyed our job and we even tried to ignore the harassment and simply go to work. But it is extremely hard to work under those conditions. We are all students and we have responsibilities, worrying about how we are treated at work should be the least of our worries. Domino's has failed to provide us with a safe work environment and in some ways they have condoned the behavior of this individual by allowing him to be employed and to have access to female employees. They have sent the message that sexual harassment is okay by failing to take any action against the harasser while retaliating against the victims. We have already filed charges with the EEOC because we want our jobs back. It is not fair that we spoke up against what was happening and Domino's ignored us and punished us. We are NOT the problem. Sexual harassment is a serious allegation and should not be tolerated in any place of work.
