NOTICE OF INTENT TO FILE A DISCRIMINATION COMPLAINT

Dear [Medical Examiner's Name],

This letter serves as a formal notification of my intent to file a discrimination complaint with the appropriate authorities, including the Tennessee Human Rights Commission and the Federal Motor Carrier Safety Administration (FMCSA).

I believe your denial of my medical card is a direct result of discrimination based on my disability, specifically my leg impairment. This decision, made without a proper skills performance test as mandated by the FMCSA, is not only unjust but also a violation of my rights.

I have invested significant time and resources in obtaining my Commercial Driver's License (CDL), including completing the required training and passing all necessary examinations. Your actions threaten to nullify these efforts, effectively reducing my CDL to a regular driver's license. This will severely limit my employment opportunities and cause significant financial hardship.

It is unacceptable that in 2024, qualified individuals are still being denied opportunities based on outdated stereotypes and a lack of understanding about disabilities. The FMCSA has clear guidelines in place to prevent exactly this kind of discrimination. These guidelines emphasize the importance of individualized assessments and skills performance tests to evaluate a driver's abilities, rather than relying on assumptions about their disability.

Your failure to adhere to these guidelines and your discriminatory practices have caused me substantial harm. I am prepared to pursue all available legal avenues to rectify this situation and ensure that others do not face similar discrimination in the future.

I urge you to reconsider your decision and grant me a fair opportunity to demonstrate my skills through a comprehensive skills performance test.

Sincerely,

Sytanya Fells
